Good morning. I think can speak for Americans of my age group who received the standard education in the US on the Constitution and Bill of Rights, I was born in 1947 and grew up in a mostly Irish Catholic section of Boson. We kids were rolled out like dough, and a cookie-cutter came along and stamped us into “normalcy” as Americans.

The Cold War was hanging over us and the Soviet Union provided the perfect image of what we did not want to be. We felt happy and safe. Even in high school, when we read Orwell’s 1984, we thought it was about Russia and didn’t imagine we could ever get a taste of totalitarianism.

I‘m here to discuss the events of January 6th.  I would like to know what happened in Washington, DC that day and what, if anything, should be done in regard to President Trump. Presently, the House plans to write a single Article of Impeachment, on Monday, saying Trump’s term must be cut short, as he has incited violence and may do more of same.

There should be a good debate on the floor as to whether he actually incited violence. Personally, I am curious as to exactly what Trump did on Jan 6th and am eager to learn more.  So far, I’ve seen a video on the Wall St Journal’s website where the president, wearing a black overcoat, is standing at a mic in front of some American flags. He is addressing the crowd in a friendly manner. I copied down his words from the video. He said:

Trump’s Speech

“We’re going to walk down Pennsylvania Av, and I love Pennsylvania Av, and we’re going to try to get Republicans – the weak ones, the strong ones don’t need any of this. We’re going to try to give them the boldness that they need to take back our country.”

So far, that’s permissible behavior, assuming he meant “We will stand outside the Capitol so they will see how many of us care. And that will give them the boldness.”  I don’t read anything more into his words, but I may be wrong on that.

As far as walking to the Capitol is concerned, it is very common for protesters to parade from one location to another. Last year in Boston there was a rally against climate change.  Some schools gave their kids a day off to attend it.  It began, as announced, at City Hall, and after a speech the huge crowd proceeded, as announced, to the State House.  There wasn’t the slightest violence.

So, the first thing I’d need to know, if I were a congressman voting on Monday for impeachment is: was there an announcement, perhaps by email, to the supporters, letting them know that the day’s event would include a march to the capitol?

Anyone Warned by Email?

I should mention that I am a Republican. I get many emails from the Party, always requesting a donation. I believe I saw a few mild statements like “Come and show your support on January 6.” Needless to say, if I saw that anything criminal was being planned, I’d have reacted with outrage, as would every normal Amercan recipient of such a letter.

Note: If the huge number of Trump supporters – who spent a lot of time and money to get to Washington — had never been informed that they were to do a “walk to the Capitol,” then I think it was unfair of the president to spring it suddenly on them (if he did.)  Emotions were high and people would have followed any suggestion from “Great Leader.”

It is axiomatic that people do not behave rationally when immersed in a huge group. I suspect that people at the front of the “breaching” were agents provocateurs, but if other innocent folk were close behind, they may have proceeded up the Capitol steps because, well, because you go with the flow.

Note: there is a clear photo of 3 cops just inside the main door who do not look at all perturbed when the “rioters” start to enter.  When I enter a federal building, I am always asked to show what’s in my handbag. Speaker of the House Nancy Pelosi had better get some answers as to what the cops were told to do that day.

Trump’s Reaction Afterwards

There is a video of Trump, outdoors, saying “Go home. We love you. Be peaceful.” He is smiling and looks relaxed, so I can’t figure out if he was aware that there had been any vandalism, much less any injuries or death.

Right now, if Donald Trump is feeling falsely accused, he could come forward with a sworn affidavit to say “I knew nothing of a plan to climb the back wall, and was completely surprised that my supporters did it, in fact I can’t see how any supporter of mine would do that – and they would know it would wreck our chances forever.”

Trump gave a televised speech on January 9th. He condemned the violence, but he didn’t say he had no forewarning of it.  The authorities must investigate — was the violent aspect planned?  Was the goal for a crowd to enter the chamber so as to be seen by the Congressmen?

In general, it’s legal for citizens to sit in the gallery – hey, this is America. Did Congress announce that the Jan 6 session would be closed to the public? What about lobbyists, did any of them prowl the lobby that day?

Trump has every right to say “Please make a big showing of your desire to get the goods as to the genuine vote count in the swing states, as I believe it was stolen.” Indeed, he has the right to fling around the term “coup d’etat.”  God knows we have instigated coup d’etat elections in other countries.

The Media

Many old-fashioned Americans today must be feeling ill at ease over two things that are being said repeatedly by media.  The first Is that Trump should not be claiming the election was stolen.  Of course he should. It’s his duty! We want fair elections. I saw a frontpage article in the New York Times on Dec 22 or 23, that said it was disgraceful of Trump to make baseless claims. (How does anyone know if they are baseless?)

Second, the media say over and over, that the Trump legal team put his case to some state courts and “lost.” No. With minor exceptions where a judge ruled against hm, the cases did not get heard.  They were dismissed upfront on a technicality, such as “standing.”  This is common lately, in many issues — it seems as if the Third Branch of government, the judiciary, does not want to be heard from!

I believe the courts’ inaction is what prompted hundreds of thousands of people to travel from their comfortable homes to stand in the cold in Washington. (Granted, some go to rallies just for the camaraderie.) Many suspected that the November 3 election was miscounted, and they knew that January 6 was the day Congress would settle the issue.

Pence and Arizona

Something that seems very odd to me is that Trump said he wanted Pence to “do the right thing” – to fix up the stolen election. Per federal law, written in 1948 (codified at 3 USC 15), Pence’s job was to be an envelope opener. He could only reject an elector’s ballot if it looked inauthentic on its face.  If the need was for a debate on the presence of voting fraud in the November election, this would call for both a senator and a rep to mutually challenge a state.

Pence correctly asked if there were any objections. As soon as the Arizona count came up, it was challenged. Pence’s next task was NOT to “deal with it” but to send all legislators to their respective chamber to debate and vote on it. However, it was just at the time of the Arizona challenge, that the “rioters” arrived. All legislators were evacuated for safety. When they reconvened at 8pm, there were more challengers, but all failed.

(This outcome was predictable since both chambers have a Democrat majority. These days, it seems Congress is never to be expected to do the right thing, but just obey a Party leader – as in the UK’s Westminster system.)

I must fault Trump, at least for ignorance, if he thought a loyal Pence could constitutionally redeem the election, over the veto of Congress. Worse, some Trump supporters probably gleaned from their president that Pence might take up this cause on January 6th.

Questions for the Impeachers

An impeachment by the House is not deadly.  It only means that the case must then go to the Senate for “trial.” So I guess it’s OK if Pelosi makes it all happen in a few hours by a Floor vote. The Senate can then dig in. Still, it will be a sad record if the House behaves in an unethical manner.

In 2020, the Senate behaved very unethically, in my opinion. The House’s impeachment of Trump, for his supposed collusion with Russia, was voted down “categorically” by the Senate. Everybody then chalked this up to the fact that the Senate had a Republicans majority.

Those Republican senators voted against hearing evidence.  Sorry, but that is not OK, even if the House’s impeachment had been Democrat-biased. Our legislature should act honorably.  By refusing to hear evidence, the senate deprived all citizens of a chance to evaluate the case.

The House needs to cover the following ground on Monday, January 11, 2021, regarding January 6th:

#1. What was Congress’s arrangement for entry to the Capitol, either by citizens or lobbyists?

#2. What instructions were given to the DC Police or security guards at the front door, if anyone entered?

#3. What evidence do we have that any members of the rally (aka “Trump supporters”) had plans to enter the building? How were such plans communicated?

#4. At the time when Trump said “Go home. We love you,” did he know that some action had occurred?

#5. Do we have evidence (not mere speculation) that Trump was “in the loop”?

#6. Has Trump been quizzed by Congressional leaders? If not, why not?

#7 Were the rallyists notified, in advance of January 6th, that there would be a march to the Capitol?

#8. Were they led to believe they had a mission to perform inside the building? If so, what was that mission?

#9. How did it come to pass that the trouble started as soon as a legislator raised an objection to electors’ ballots from Arizona – which was what Trump’s supporters had hoped for and thus did not warrant their anger or opposition?

#10. Whose camera took the close-up video of the now-deceased cop being squashed by a riot shield?

#11. Whose camera took the video of the now-deceased lady with blood in her mouth?

#12. Have members of Congress read Sidney Powell’s 270-page report of election fraud?

Note: Cases can still reach the US Supreme Court, in regard to election fraud. Neither Jan 6th nor Jan 20th is a deadline for justice.

My Prejudices

I don’t think I am prejudiced in regard to the election fraud or the violent episode at the Capitol.  I also don’t yet know if have got the story straight! I’m rushing to print so readers will learn that everything about Monday’s impeachment action does not have to be “political.” It can be reasonable.

Most Americans, I guess, feel frightened — as it’s so rare to see our honored buildings defaced. And surely people are reeling over the fact that a business organization (Twitter) feels it is OK to cut off the communication between the president and the people of the United States. Wow.

In Boston’s regional office of the DoJ, US Attorney Andrew Lelling has said that he will indict any Massachusetts person whom he finds to have participated criminally in the mayhem.  That’s fine, I am all for law enforcement, although I don’t see why it wasn’t dealt with on the spot.

A bit more about me.  I sued Trump in 2017 for his unwarranted claim to have the right to ‘nuke’ North Korea.

I also ran against Trump in the Republican primary in New Hampshire in 2020. (He got 129,000 votes, I got 925.) This does not prejudice me in regard to Jan 6th. I hope Trump comes up clean.  If not, I’ll go along with impeachment.

I am the author of relevant books, such as Prosecution for Treason (2011), and The Soul of Boston and the Marathon Bombing (2019).  I say the Marathon bombing was a false flag and have sued the FBI and the Boston Globe over it.  I feel that Jan 6 was a false flag, too, but “feeling” does not count.  We need the facts.

I advise against feeling defeated. And don’t swerve into the lane that says “We’re all headed into Emergency mode.”

Come on, Yanks.  Get with the program. Hold all elected persons accountable. Meet them eyeball to eyeball. You know you can do it.  Cookie-cutter senior citizens especially.

    The whole “Trump incited violence” was the biggest false flag of the decade. What nonsense, especially when you see security usher the “protesters” (and also photographed with Pelosi’s daughter etc). The Dem puppets have been encouraging all US-summer BLM and Antifa actions. You can see them inciting the crowds on Youtube.

    I don’t think we need to debate whether Trump incited violence — because it was so obviously staged to allow the mainstream media to try make him out to be the enemy of the people. All of his rallies were peaceful. Nothing different. I don’t want to play into their hands — when the decit and treachery is so BLATANT.

    And to delete his twitter account permanently — stunning. If they can do it to the King, they’ll be happy to put cement blocks on your feet and drop you into the ocean. Good luck.

    • I’m sure it’s just a distraction for the MSM. The Deep State have to absolutely demolish him in any way. I tend to believe G5 that once he opened the JFK files that exposed the mafia/banking/oil/CIA coup of the US government, Trump had to be “goned”. Too dangerous to have the most powerful man declassify and show the American people they were betrayed.

  4. I know I keep harping on about there being two jurisdictions, one for the de jure people and their body politic, and another de facto which is legal and can only be used by legal fictions and those people pretending to be such.

    Someone who identifies with the legal fiction represented by the government created entity having the form of the Birth Certificate can only operate in the current legal jurisdiction unless they have changed the default relationship they have with the government. (To do this involves some banking, trust process and using the inherent jurisdiction of equity.)

    Just to be clear of the historical perspective, the de jure jurisdiction was, to all appearances, seamlessly supplanted by the de facto jurisdiction in the early 1930’s when western governments all had financial emergencies and were put into administrative receivership.
    That is when gold and silver were claimed by governments and put into trust for the people (who owned it as well as all the other assets on and in the land), and the lawful money was replaced by fiat currency, i.e. legal tender.

    This may be the explanation for:

    I am domiciled on Tasmania, and the current Supreme Court Act (1932) for there, as well as the same act for W.A. (1935) only allows legal fictions (specifically – corporate soles and corporations, both of which are creations of government) to file as petitioner, plaintiff, applicant or complainant.
    Try filing as one of the people without knowing how to navigate through the rocky shoals they have put in the way.

    The US jurisdiction would be no different as they went through the same process.
    Because there was a sleight of hands when the change-over occurred, and the administrators profit from the ignorance of those who identify as “citizens” of the corporate body politic, what presents as the ‘law of the land’ is a mish mash that makes no sense for those who think they have ‘constitutional rights.’

    And it most likely is for this reason that standing was denied, because the filers were seeking something that pertained to the unalienable rights of the people, but were presenting as legal fictions.

I’m not even American, so know not very much at all about American politics and the legal system. I’m a retired Australian psyche nurse who is utterly horrified at this situation, and can see BIG trouble looming. I think Trump and Giuliani are too well seasoned to be naive about Pence being able to throw a spanner in the works of Congress on that fateful day.

    Trump (IMO) would KNOWINGLY, not naively, suggest to the crowd that they should somehow ‘encourage’ Pence to prevent the vote from going ahead. At any rate, Trumps lawyer, Rudi (let’s have trial by combat!) Giuliani, surely would have come out onto the stage, and very discreetly set right any misunderstandings that people (Trump) might have about the legal limits of Pences’ role. That he was just the envelope opener for the day…Lest the crowd get the completely wrong message, and believed that Pence would be letting the team down if he didn’t ‘do the right thing’. And Donald (‘you can be a hero, or you can be a zero’) Jr, assured the crowd ‘we are all watching’, as HE worked the crowd. It seemed to me that the ALL speakers were working the crowd. Working them to a common goal.

    Nup, this rally was timed and placed to be convenient to disrupting/preventing the vote – IMO. The rally speeches fell, of course, legally short of incitement.     A reporter describes how they were at the Capitol building around the time of Trumps speech — that in fact a small group had advanced to the doors before / while Trump was speaking 45 minutes away.

    Those who listened to the President would have had to have walked about 45 min to get to the steps — arriving at 1.56pm arriving over an hour after the first people started to intrude into the building.

    MM this may easily explain to your readers that Trump could never have incited those people.
