The FDA Has No Authority on Treatment — It’s a Product Safety Agency

Suppose you lived in a nation where merchants routinely cheated you by, say, labeling a can of soup as containing 30 grams when it only contained 27 grams. I think you would want there to be some kind of governmental oversight such that the practice would be noticed and constrained by a law.

Suppose you lived in a nation where goods were transported across state borders, but no state wanted to bother cracking down on cheaters as it hoped that this job would pass to another state. I think you would want a national authority to take responsibility, in the light of such buck-passing.

Well, wouldn’t you know it, when the Framers designed the US Constitution in 1787, they took care of both problems. They gave specific grants of power to Congress, as listed in Article I, Section 8.  Behold Clause 5: [power to] “fix the standards of weight and measures,” and Clause 3 “To regulate commerce across the several states.”

Oh, I hear you muse “And we’d like a grant of power to be allocated to Congress to guard the nation’s health.”  Well, stiff biccies, the Framers did not do it, and if you want it, you must muster 38 states to amend the parchment.

Hang on.  Isn’t there a Public Health Service, a National Institute of Health, a US Surgeon General, a Center for Disease Control, and all sorts of other paraphernalia to indicate that Congress has a mandate? Yes, but they are unconstitutional and want to be consigned to the dumpster asap.  I’ll get back to that below.

Yesterday, August 23, 2021, newspapers in many US cities headlined the “wonderful news” of the Pfizer vaccine — or should I say the Pfizer ‘vaccine’ — getting full approval. For example:

Houston Chronicle: “The Pfizer vaccine’s change in status appears to give cities, school districts and universities a way around Governor Greg Abbott’s ban.”

Washington Times: “Hospitals, governors and the military wasted little time Monday in requiring their workers to roll up their sleeves after the Food and Drug Administration fully approved a COVID-19 vaccine for the first time.”

Ralph Nader’s Predecessors

As far as I know, the FDA itself does not claim to offer any advice on health. It is a Ralph Nader type of thing that came into being way before Ralph Nader did his seat-belt bit in the 1970s. FDA stands for Food and Drug Administration — note: the word ‘Administration’ suggests it has no power.

It grants licenses for the manufacture of products that it deems safe and honest. It says nothing about whether you should use the product — that’s up to you.

The FDA was ostensibly a response to the Muck-rakers of the 1920s. I say ostensibly, because, like everything else in 20th century American government, this caper was run from behind the scenes. I am guessing that the muckrakers were part of the game. They did exposés, aided of course by the media, showing for instance that some canned meat was rotten.

Ida Tarbell (1857-1944), a leader of the Progressive movement, was an “investigative journalist” who wrote The History of Standard Oil. It was said that her book led to the break-up of the Rockefeller oil monopoly. Wait a minute — she bashed Rocky and yet lived to the age of 86?  I don’t think so. I am guessing (only guessing) that she was instructed by Rocky to make the public think he was getting a well-deserved bashing. (It was bash-lite.)

Forgive me, but I believe — given what we now know of Big Pharma’s conscienceless behavior — that all aspects of the legislation that governs the FDA would have been put in place primarily at Big Pharma’s behest.  The goal would be the making of huge profits, and the persuading of medical students and doctors to prescribe pills.

It would be necessary to fool the public into thinking that the federal bureaucracy known as the FDA has some sort of obligation to help us be healthy. Indeed, yesterday, in announcing the approval of the Pfizer vaccine, Janet Woodward, MD, acting director of the FDA said “this is a pivotal moment for our country.”

Oh really? Doesn’t she know that the “vaccine” is not a vaccine but a means of genetic alteration? Doesn’t she know that proper studies were not done?  Doesn’t she know that thousands have died from taking the vaccine during the period when it was allowed for “emergency use” — never mind that there was no emergency?  Apparently not.

Unconstitutionality

When campaigning for the Republican nomination in the 2020 presidential primary in NH, I was asked, on C-span, some detail about my health platform.  I started to say “This is a federal election; I don’t have any health stuff on my platform.” To my surprise, the questioner, a lady from WMUR-TV, immediately nodded and changed to a different question. Very few citizens understand that the federal government has only a limited number of things in which it can legitimately participate.

The FDA’s website says the FDA is “responsible for protecting the public health by assuring the safety, efficacy, and security of human and veterinary drugs, biological products, medical devices, our nation’s food supply, cosmetics, and products that emit radiation.” [Emphasis added]

The phrase “protecting health” is a bit off the track, but it is legitimate for this agency to “assure the safety, efficacy [etc] of drugs, medical devices [etc.] thanks to Clause 3, better known as The Commerce Clause in the Constitution, which allows Congress to regulate interstate trade.

Yet for FDA to intervene in any way, in deciding whether the Pfizer drug should be used, is unconstitutional. And it is wrong for the FDA to give the public the impression that it would like you to run out and get vaccinated.

Recall that the Houston Chronicle said “The Pfizer vaccine’s change in status appears to give cities, school districts and universities a way around Governor Greg Abbott’s ban.” I am not sure what the governor banned but I can say that a change in Pfizer’s status — and by the way a wholly dishonest one — cannot make the governor change his plans.

The Washington Times said military will be told to “roll up their sleeves after the Food and Drug Administration fully approved a COVID-19 vaccine for the first time.” That is truly nuts. The military will make the decision according to other factors. By the way, it is not OK for the military to insist n a Covid vax. I suppose if the soldier is about to enter an area known for typhoid or yellow fever that his commander can command him to take the relevant prophylactic, but this is not comparable to Covid.

This is not to say that soldiers are safe from wrongful commands. Viera Scheibner has studied the effects of anthrax shots on soldiers, and the likely cause of Gulf War illness that followed the Desert Shield and Desert Storm operations. I quote her “The compounds given to personnel made the recipients very ill, some 6000 personnel died from them and they incapacitated tens of thousands more.”

Also, Scheibner notes: “A TV show on the Gulf War Syndrome interviewed a number of [Aussie] veterans who testified that they were forcibly vaccinated with up to 23 vaccines within 2 weeks and were held down by several men when they just ‘inquired’ what sort of vaccines are in those injections.”

Soldiers who disobey orders can get a triple punishment: dishonorable discharge, forfeiture of pay, and the brig for two years. But there are grounds for appeal if the orders were faulty.  Moreover, a soldier has an established duty to disobey illegal orders.

The CDC

Perhaps the CDC shouldn’t even be acknowledged as an unconstitutional government venture as it isn’t really a government venture.  It started out as a private organization, with Rockefeller involvement.  It now gets mucho federal funding. But I can say unequivocally that the CDC cannot legally force any doctor or patient to do anything.

The way in which the doctor gets controlled is by his state’s branch of the AMA. The usual suspects have infiltrated every state legislature to make sure that the AMA is given a hold over doctors.  They can call for a doctor to lose his medical license if he fails to follow “best practice.” The best practice may be one derived from CDC, Big Pharma, or worse.

I am well aware of doctors being persecuted for using good treatment of cancer and autism. Greg Caton, for example, invented a successful cure for skin cancer, known as Black Salve.  This put him in jail for 5 years. Sure the public would wish to be protected against snake oil salesmen.  But the real snake oil salesmen do not suffer so much as an investigation.  They are protected. Note that autism doctor, Jeff Bradstreet, MD,  had his office raided by the FDA the day before he died. His autistic son had just graduated from high school.  You know Dad was not suicidal, not at all. But when he was found in a river in North Carolina, in 2015, police called it a suicide.

The CDC tells each state’s AMA which pre-school shots are required. The schools then act as an enforcer — they won’t enroll unvaccinated children.

The biggest giveaway of the ujnsavory (I really mean malicious, or genocidal) behavior of the US government in relation to the Covid affair was the withdrawal from the market of drugs that had worked well for years (both on humans and animals) for Covid-like symptoms, namely, ivermectin and HCQ (hydroxychloroquinine). Paul Craig Roberts has said that the ban shows a racket being run by “CDC, NIH, WHO, and FDA in cahoots with Big Pharma which does not want the information out that a cheap cure for Covid exists.”

Finally, to the hilariously unconstitutional US Public Health Service. It could never have been brought into existence legitimately by Congress but the usual suspects found a back door.  There were seamen in ports of East Coast who had not hospital to go to if they got sick. So the very first Congress, which sat from 1789 to 1791, passed “An Act for the Relief of Sick and Disabled Seamen.”  It was called the Marine Hospital.

That hospital needed a boss, right? Voila, a Surgeon General. By 1978 it gave that Marine Hospital a right to enforce quarantine.  In my opinion, this was to ready us for the next move by which a Quarantine Act was enacted, to deal with the worry about cholera in Europe. Soon the Marine Hospital would be renamed US Public Health Service.

In living memory (1964), the US Surgeon General wrote messages on packs of cigarettes warning of the health hazard.  I know you think I am a bit nutty to worry about the unconstitutionality of all that.  But I do.

So let me end with a word about off-label uses for drugs.

In 2013, a New York man, Alfred Caronia, was prosecuted for promoting certain medical drugs for purposes other than the ones the FDA approved them for. Doctors have always had the right to do this off-label prescribing, but drug salesmen did not. Caronia was caught in a sting phone call saying that the date-rape drug could help various conditions and could be given to under-16’s. He told the court that the rule that gagged him was a violation of the First Amendment. The Second Circuit overturned his criminal conviction.

That’s constitutional.  I’m happy.

    Folks, this isn’t a real “approval” by the Food and Drug Administration; it is a “double-down” on the EUA issued under President Orange Potato. It’s a “fugazi” and a hedge, because they can then say, we did not really approve the Pfizer jab per se, we just endorsed its continued use under the EUA”.

    This way the drug company still does not have to provide the pharmacies with the usual form back-up stating what is in the concoction, its suggested use, its side effects, and all of the necessary disclaimers. They can still send BLANK DOCUMENTS to the pharmacies.

    Naively, three months ago pressured by ‘better half’, I took a booster shot to see grandson’s birth. Doc said it was for whooping cough immunity, arm still hurts. If you can, escape to regional areas where there is natural food source such as fish. I missed many opportunities to leave this damned city, being soft, indecisive and listening to others. To those still sane, do not hesitate in leaving this suburban prison of all minds. The screens are BS – tell lies vision every word of it untrue.

    • This morning they are going hard on their weird Afghanistan exit, they are following orders from the Taliban now, not a word about Russia, it becomes more and more obvious that Russia has kicked them out ( again, as in Syria about 8 years ago ).       • Hundreds of years ago kings had to prove themselves on the battlefield, in those times wars were still more-or-less tribal. At some point the kings retreated to a castle on a hill because they had gone mercantile. The wars expanded from tribal wars to race wars but the mercantile element went unnoticed by the serfs because they didn’t deal in big sums of money. The war we have now, cold war 2.0 bio-weapon enhanced is a pure class war, it isn’t jews, it isn’t “all wars are bankers wars” though jews and banks are amongst the weaponry. This is the top 1% against everyone else. Divide and conquer is being practised at all levels. There are clearly NO racial distinctions at all, unless you like to look at Switzerland in that way, but even they have big branch offices, London, Paris, NY, etc. What everyone needs to realise is this 1% is what they are up against, until then the sheeple will just be running round in circles. Some would say the 1% should actually be 0.1%, I would say it could just as easily be counted as 2% or 3%.
        As a disclaimer I would say I am not some embittered lefty, and I have never carried a placard or thrown a brick in my life. I like to think of myself as a pragmatist.

    ABC News’ Brian Hartman Reports: Sen. Charles Grassley, R-Iowa, released a remarkable letter today that nine staffers from the Food and Drug Administration have sent to President Obama.

    The staffers are ecstatic about new leadership at the FDA but want bad managers who still remain on the job to be run out of the agency, and in some cases, prosecuted as criminals. The staffers, whose names are redacted, call for an end to “the culture of wrongdoing and coverup.”

        • HSBC is notorious, they were recently in a scheme where HongKongers could deposit their money in a HongKong account and get credit in Sydney, without the money ever leaving HongKong. I guess it was just locked up in the HongKong account forever. I think this may not have pleased the CCP. HSBC presumably would swap it out in some other way. This would be one of their more harmless schemes I would say.
          Realistically, we must understand accountants exist to dream up schemes and if they are incapable of that they are just drones or, they could only do worse, such as various types of outright theft. They are after all fixated primarily on getting money by the most direct route. They lack a genuinely useful talent. They seem to exist to exploit and subvert the law, as anyone knows.
