This lawsuit is superb.  It is brilliant. It will solve the problem of Free Speech.  Thank you, Twitter, for making such an egregious error in shutting down the communication of a sitting president of the United States.  Thank you, Jack Dorsey, for buckling under pressure from (then) Senator Kamala Harris, Senator Richard Blumental, Nancy What’s Her Name, and the CDC, such as to make possible this searing plaint to the courts. Thank you, CDC, for being your usual awful self, harming us citizens to the max.

Gotcha. You are done, the lot of you.

I am a conservative Republican. You may be surprised to hear that I thought Donald Trump was a terrible president. The “Muslim ban” floored me, simply floored me. I never had the sense that the president knew, or cared, what was in the Constitution. I sued him (Maxwell v Trump) in 2017 over his threat to nuke North Korea. His moving of the US Embassy in Israel from Tel Aviv to Jerusalem was a sacrilege to people of all three Abrahamic religions. It was jaw dropping that he chose John Bolton for National Security. I am currently in appeal (Maxwell v Secretary of Defense) against mandatory vaccination.

I ran against Trump in the 2020 New Hampshire primary for the Republican presidential nomination. I was glad that Trump didn’t get a second term, though I find Biden’s administration horrific and surreal. I know for sure that the election was stolen and that the “rioting” at the Capitol, on January 6, 2021, was done by agents provocateurs. And by the way, I hate the partisanship that has become childish on both sides. This “Westminsterization” of our Congress has been making representative government a joke.

It’s a Wow

That said, Trump v Twitter is a genuine constitutional solution to many problems. Even if it never flies – though I expect it will fly – the accomplishment is already there. Below, I will print the whole thing, or almost all of its 9,000 words, skipping a few items that were repetitive. I have bolded the many, many excellent points made by Trump’s all-new legal team. They should get, I dare say they will get, medals of honor. I offer them the Maxwell litigation salute.

Here is the gist of the case, in Nine Points:

Point #1.  As everybody knows, Twitter chopped off the communication between (then) President Donald J Trump and his 88.9 million Twitter followers.

Point #2.  They did it by way of Section 230 of the Communications Decency Act, 1996,  that protects from liability the social media companies that may censor someone unconstitutionally.

Point #3.  This is a new one on me – social media companies  (e.g., Twitter and Facebook) were furnished with this trick, in Section 230, IN ORDER TO MAKE POLITICAL CENSORSHIP HAPPEN. (I faint!)

Point #4. Members of Congress (including Adam Schiff of impeachment fame, oh please) bullied Jack Dorsey to do the de-platforming, against his better judgement.  They threatened him with all sorts of loss of business and personal embarrassment – as is their wont.

Point #5. “Legislators” made known their desire to prevent publication of “COVID-19 “misinformation,” including the lack of safety and efficacy of hydroxychloroquine and the use of face masks,” and “Questioning the integrity and results of the 2020 Presidential election.” Dear God.

Point #6. The CDC (I retch) was no innocent bystander. At Paragraph 77, please find:

“The CDC has publicly stated that it works with “social media partners,” including Twitter, to “curb the spread of vaccine misinformation.” In a document dated October 11, 2019, the CDC expressly stated that it was “engaging . . . partners” to “contain the spread of [vaccine] misinformation” and specifically states that the CDC would “work with social media companies” to that end.”

Point #7. There is real constitutional content here, as in the making of culture, e.g., in Paragraph 61 of the lawsuit we read:

“By banning Plaintiff, Defendants have made it more difficult to communicate directly with the American public. Our national discourse is becoming immeasurably more altered and one-sided on race, medicine, the election process, the economy, immigration, etc.”

Blessed, blessed relief just from seeing that in print – in a Court of Law.

Point #8. And this precedential beauty at Paragraph 114:

“In censoring the specific speech at issue in this lawsuit and in deplatforming Plaintiff, Defendants were acting in concert with federal officials, including officials at the CDC and on the Biden transition team.  As such, Defendants’ censorship activities amount to state action.” [I have never seen that argument before. Where have I been all my life?]

Point #9.  You knew I’d save the best for last, concerning Mr Facemask himself.  I will try to see that arrests, by citizen’s-arrest if necessary, follow. (Oh, you think you can get me for incitement? Oh yeah? Try it! Deplatform me!)  The corpus-delecti-to-be is at Paragraph 78:

“Dorsey and Twitter acted to censor other medical opinions that did not uphold that narrative of Dr. Fauci and the CDC, which took on both a political and medical nature, given the interconnection between government policy and pending and science.”

Are we thinking a 18 USC 1983 prosecution?

Hugs and kisses for the US Constitution. You rock, James Madison! You shine, George Mason! Luv ya, all.

Oops, I forgot to say that Trump is not the only plaintiff.  Also in the case are the American Conservative Union, a single litigant named Linda Cuadros, and what is called the Putative Class, a potential huge number of people (maybe some from Australia? I know at least one dual US-Oz citizen) whose accounts were suppressed for not meeting community standards.

Please, Readers, rejoice with me.  This case is unanswerable. It is filed at the District Court of Florida. The judge has only to agree that an injunction is warranted. Lucky him or her. His or Her Honour will become famous for SAVING AMERICA AND SAVING THE WORLD.

Our troubles are over.  Amen.

  1. Mary I am very pleased that you are pleased, as I know little of law. You once again give me hope that we, the people of the world will be released from the tyranny of hundreds of years.

    A disturbing account of something to which I have a first hand knowledge.

    I as a Veteran have a cleaner supplied through Department of Veteran Affairs to do an hour’s house cleaning once a fortnight. She or he is employed by a Service company.

    The current cleaner knew my beliefs on the Covid-19 subject and the “vaccine”.

    On 14th July she brought up the subject and stated that she did not want to have the “vaccine”. I told her that it was illegal for anybody to force or coerce her to be injected against her will.

    She usually arrives earlier than necessary, but on the 28th July she was a few minutes late. She carried on with her tasks and when finished said “Mal, because I am in the care industry I had to have the vaccine”. (In other words she was coerced.) She then told me her heart has been racing and for the first week after the “vaccine”her blood pressure became higher every day. In the second week it started to come down, but she didn’t say if it came down to normal. I suggested she go back to her doctor to tell him/her and require them to report the incident to the Health Department so that others might not be caught out. I don’t know if she followed my suggestion.

    However on Saturday morning 10th August I had a message on my recorder from her employer sent on Friday morning at 10.09. That message stated that Cathy would not be available for work on Monday morning as she has booked in sick. So the employer knew early Friday at the latest that this woman was very sick, to be unavailable for at least four days. My fear is that maybe there is a worse result and this is the company’s story to me. I will ask Cathy’s replacement tomorrow if they know Cathy’s health situation.

    I have learned from medical specialists over the internet that the Spike Protein in this “vaccine” can injure the heart muscles and even change the shape of the heart. Heart muscles DO NOT regenerate when injured. So if this woman is not deceased she will have a weakened heart for the rest of her shortened life.

    Once I have questioned Cathy’s co-worker I will be sending an email to McGowan, and Cook, relating this event and once again demanding a stop to the “vaccine” roll out.

  3. Mal & Ned, I appreciate your contributions to the flow of information. Saying that, I recently had a lunch with several people from my community. I have told them about Port Arthur and a few other things, they seemed to have absorbed the magnitude of those events. Then, when we were having lunch the topic of the plandemic came up. One lady who I respected, looked at me with a ‘seeking approval’ eye that she had had her first injection. Then another fellow smiled and looked at me with a smug (aren’t I cool) look that he was having his second injection that afternoon.

    This reminds me so much of the gun control agenda back 30 years ago. – Many people are so dumb that they don’t know that they are dumb.

    It took some 30 years for some of the dumbasses in the Australian community to wake up to the gun control agenda. We are at the beginning of this depopulation agenda and I don’t think I can do much to turn it around based upon my former experiences. Pardon me if I bow out this time, I’ve got a garden to weed.

  5. Mary , What a great insight into this case, thankyou for your efforts in putting it together. Are you aware that Alan Dershowitz is involved in the case , he is a key witness , as well as part of the class action group. He was actually de platformed for conversations with Kennedy Jnr.
    They are claiming the damage’s if awarded will be in the Trillions. Lets pray for a successful outcome.

      • Islam was from my perspective incentivated as a reaction to Constantine’s taxes (equally cultural imperialism), but Mohammad designed various elements to suit his own proclivities. You can accept some “fundamentals” of Islam by applying “don’t shoot the messenger” even though it’s maybe an extreme case. It’s a mystery how muslims in the US reconcile themselves with the 1st amendment, also why they are happy to carry the can for 9-11. Islam is a system of governance with religion thrown in the mix. So when you say “religious rule”, it is not really religious rule at all, it’s a system of governance in itself, which is designed to be applied in the absence of usury !!!

    • Yeah Tony, I’ve done a fair bit of sailing. First trip was from California to Hawaii, then 6 weeks sailing around the Marshall Islands. Too bad the kids of today won’t be able to have those adventures, but maybe, if they get off their asses and fight for that right.

      Along the coast there is plenty of food. Over in the Marshall Islands I used to drop over the side and pull up a couple of giant clams for dinner or spear some fish. Even back in California I used to have lunch with some abalone I harvested.

    I’d have thought the issue was more toward populous folly, i. e. the masses being fooled into believing entities such as Facebook and Twitter are public facilities when they’re really nothing of the sort

    At a stretch I guess they could be sued for assuming a faux appearance (misrepresentation) but nothing more; it strikes me that “legislation” such as the Communications Decency Act has actually played a key role in said heist

      Just reminds me about a WA potato farmer who took on the regulators and started a family business supermarket chain called “spudshed”, immediately the eastern states Woolworths I think pounced on the brand name, for bagged potatoes.

      We hear about the corporate ownership or control of the patents office and can only imgine that anything comprehensible to “them” must be promptly (and legally) stolen.
