Wangaratta magistrate Ian Watkins was arrested last Friday during a civil hearing he was presiding over in the Wangaratta magistrates court.
Local Photographer Dezi Freeman initiated the arrest after directly challenging the authority of the magistrate due to breaches of State and Commonwealth law.
The public gallery was filled with supporters of Mr. Freeman who bore witness to the proceedings including certified Commonwealth Public Official Mr James Rech, who stood up in the court and reiterated Mr. Freeman’s statements.
“Magistrate Ian Watkins was told to stand down and I instructed the Policeman present in the court, Craig Robinson to execute the arrest who then failed to do so in an act of malfeasance of public office and negligence of duty” Mr. Rech said.
Mr. Freeman, a Photographer from Myrtleford has been fighting against an attempt to block the Community’s right of access to Mt Buffalo National Park along the Buffalo Creek road, Myrtleford.
Buffalo Creek recently attracted widespread national media attention due to continuous attacks on Mr. Freeman and his family which was reported by A Current Affair.
Self represented in the case, Mr. Freeman has fought against local Lawyer Charles Morgan and VicBar Barrister Timothy Chalke (Castan Chambers, 460 Lonsdale st. Melbourne.) for the past year in his bid to uphold the community’s access to Mt Buffalo.
“The lawyers are profiteering from working directly against the community’s interest. I would have thought their reputation would be more important to them than money” said Mr. Freeman.
“It’s ridiculous that I have been to court nine times now just for bushwalking. It’s an insult to our community and the tourism industry and a gross waste of taxpayers money to even debate our access along a road that has been used to access Mt Buffalo for over 100 years. There have been multiple procedural errors in this case and the course of justice has been perverted.
Magistrates are not above the law and I will be holding them accountable for every last law broken and abuse of process that they commit unless they cease their relentless attacks upon me in this ridiculous, vexatious case”.
Commonwealth Public Official Mr. James Rech explained that the Supreme Court of Victoria has already set a landmark precedent in relation to such long used roads and their status as public highways at common law. “The Wangaratta magistrates court is attempting to contradict the Supreme court which it has no authority to do.
It is clearly not a court of competent jurisdiction and has ignored overwhelming evidence presented by Mr. Freeman. The way this case has been handled and the treatment of Mr Freeman is disturbing to say the least.” Mr. Rech says the case has been nullified by the arrest of the magistrate and the fact that he stood down as a result. “Magistrate Watkins had no answer when directly challenged on Constitutional matters and grant of power”.
“He then attempted to railroad the process but was quickly shut down by Mr. Freeman who exercised his duty under the Constitution to make the arrest”.
Mr. Freeman has overwhelming community support in keeping the road open to the public, while Magistrate Watkins is expected to face charges of Misprison of treason as well as charges relating to fraud and perverting the course of justice as a result of his arrest.

As I understand this; the Magistrate was not physically arrested and removed. It was more of a technical paper based event.

I would argue that, strictly speaking, the word “arrest” means “to stop forcibly; check or hinder the motion or action of”;it has nothing to do with the deprivation of personal liberty per se.
In this particular case a magistrate’s intended course was stopped short.

I guess my point of “they are all the same” comes from your observation of the deaths and miseries caused. Same tactics throughout history(I don’t have access to secret history). As one example, look at the victorious armies coming home, now and those periods(Roman legion etc) I pointed out. Riddled with disease, and taking it back home.
I think ancient Rome and other well documented ancient superpowers were prior to the Jesuits. I think the Jesuits just had a baton passed to them, but they were not the first to use that modus, and I don’t leave them off the hook, ask Ned.

I don’t doubt your knowledge of the bible but which version. I only pointed out that that some ceremonies in the Catholic Church required due process that was not necessarily INSTIGATED by the receiver. Once again, Oz needs to become a “Constitutional Republic” with the People writing that constitution.
Actually, Carlo, the concept of constitution is a device created by the enemy elite. It is intended as a paper tiger with which we have recourse when oppressed, only to discover too late it has no power.
For example, most nations invaded by the US (57 since WWII) had constitutions, which did them no good whatsoever. And no national constitution contains the word DEMOCRACY, this being excised by the lawyers before ratification (the prime purpose of the law society).
Finally, instead of a constitution, we need a document which states initially that ALL AUTHORITY RESIDES IN THE PEOPLE.
Then, that all government policies must be formulated by a fully-informed electorate. The role of government then is merely to implement the WILL OF THE PEOPLE, which is what a constitution is purported to guarantee, but always fails to achieve.
Finally, the third rule demands consensus, (not a majority) before a policy is converted to law.
For the record, when a population of people (regardless of size: (ie nation, region, or neighbourhood), have access to all the information they require about a given issue, consenus is always around 97%. This is because all people, regardless of race or culture, have the same fundamental values… they just want their families to be happy.
And when the process towards consensus evolves, people respond accordingly and defer happily to opinions they respect. People have a natural affinity to wards agreement. Just watch two people agree on something, they cannot help smiling. We are hardwired to love consensus. Social scientist, political scientyists and power lobbies have long campaigned to convince us that PEOPLE CANNOT AGREE. It is a lie.
This is not theory or hypothesis. it was proved in an experiment with 3500 people in Darwin in 1985.

Australia urgently requires or needs major institutional changes. I assume that Mr Freeman(how can this not be a setup) has driven some way up a dirt track, parked his car and then continued on foot for bushwalking/photography. What happened then, I have to assume his car has been ticketed on multiple occasions(9).
AR News could have supplied the details of the dispute. ie booked by council officers travelling on a bush track/firetrail. Just to clarify a couple of terms: Australia is an application of the republican system of government, with a house of representatives and a senate.
The westminster system is a monarchy (the top elite), with below that the House of Lords, (the secondary elite), and at the bottom, the House of Commons (ie elected representaives of the commoners/ peasants/ serfs).
Neither bears any relationship to a democracy, which is that form of government in which policy is formulated by all of the people and in which no power hierarchy exists.
No democracies exist today, the last being destroyed by the Dutch in Indonesia 200 years ago.
The two people behind this have seemingly launched 2 – 3 further such prosecutions for Misprison of treason.
Would it not bet more appropriate to charge for sedition among other charges?
