A New (Old) View, by “Lord Gumption” and a Vote for Civil Disobedience

The website UnHerd – what a good title – contains an interview, by Freddie Sayers, of a recently retired judge, Lord Jonathan Sumtion. This UK Supreme Court justice is standing out from the establishment crowd by encouraging civil disobedience to inappropriate laws related to Covid, such as the Lockdown.

The video of the interview is dated March 4, 2021, last Thursday. It appears to have been made in the lush home of Sumtion. The interviewer, Sayers, is there to draw out of the judge his real opinion – he (Sayers) does not push his own thoughts.  Shall we say, he is no Anderson Cooper.

I was interested to hear the judge, age 72, refer to the stalwarts of political theory – Thomas Hobbes (kowtow to the Leviathan in exchange for protection), John Stuart Mill (try not to yield liberty), and Aristotle (democracy will collapse because the citizenry is a sucker for a demogogue).

Pardon me, but the last time I heard those three guys mentioned together was in the Monty Python song:

Has Done His Homework

I had to bow to the superior wisdom of Justice Sumtion in the area of the effect of the Lockdowns on employment.  He says major protest by workers is not yet occurring as the UK government is supplying “furlough” pay to those who are out of work due to the pandemic.

But it’s brewing beneath the surface, he says, and it will be the young who are most affected. They form a large group who were just coming onto the job market anyway.  And the sacking rule of “last in, first out” will apply most severely to hem.

Moreover, according to Sumtion, the young are he generation out there that has the least adherence to liberal democracy. He did not decry the educational system for this, as I would, or blame the media and entertainment industry, as I would, but probably he is right. He says collective conventions last a long time, but may be quick to dissolve.

Sayers interrupted to ask if the loss of religion was a factor. Sumtion does not seem to think a particular religion matters, but a general acceptance of what is right and wrong is the basis for cohesion.

He says we (in UK) have had a liberal democracy only since mid-nineteenth century. By the way, Lord Sumtion is a historian of the Hundred Years War, in 4 volumes! Freddie Sayers asked him if people are ready for a change because of the two political parties being so “una voce.” The judge agreed that people are fed up with that.

Do As Thou Wilt

“Justice Gumption” openly espouses civil disobedience, saying there is no moral obligation to obey the law. He also votes for common sense – “If Covid is an illness from which 99% recover, that does not qualify for extreme emergency measures to be taken. He said the government should learn two things:

“My first proposal is that governments should not treat information as a tool for manipulating public behaviour. They should be calmer than the majority of their citizens; they should be completely objective.

“My second lesson would be that governments dealing with scientific issues should not allow themselves to be influenced by a single caucus of scientists. They should always test what they are being told in a way that, for instance, judges test expert opinion by producing a counter expert, and working out which set of views stacks up best.” [Emphasis added]

Mandatory Vax

Gumshoe will link the 51-minute YouTube interview below.  I stopped halfway through and read the comments under the video. It seems that partway through the video, there is a change of horses. Gumption goes into retreat and agrees with the policy of mandatory vax!

TrueNature  — He lost me on his stance on passports. It completely unreasonable to expect anyone to orientate their lives based on other people’s irrational fears. To base one’s decisions on fear is a huge mistake for any individual never mind a whole planet! Passports are coercion.

Elizabeth Blackwell — I agree with Lord Sumption except on one matter: The risk of the virus does not justify the risk of the vaccine. The vaccine cannot have been adequately tested and therefore represents a far higher potential risk than the risk of long-term deleterious known effects of the virus.

Sarah Thompson  — He’s no ‘renegade’ anymore, he’s taken the vaccine just to comply and be ‘allowed’ to go back to theatres and restaurants. He knows there is no real threat to life from contracting covid. I’m very disappointed in him. How harsh to accept that anti-vaxers will be put into a category where they will not be allowed access to ‘normal’ life like people who break unjust laws must accept the consequences. Clec Torres  — If this whole saga was as serious as being published, common sense would prevent people from wanting to travel, go shopping, walk and talk near someone else, yet the argument were not allowed to debate is why has common sense been made illegal? Look at the motive of this covid and you will see the outcome they want.

At the website UnHerd, commenter Caroline sad:

“People need to take off the masks. They are a symbol of subservience and compliance. Science is simple really. You breath in oxygen and you breath out carbon dioxide (waste matter). So, by wearing a mask, you are seriously compromising your immune system. Oh the irony. I wish people would get educated, then this would be over tomorrow!  I’ve never worn a mask, and I never will. I would rather die on my feet than live on my knees. People need to wake up to the fact that we have a rogue government in power and Labour, under Starmer (think Rotherham) are no better! Wakey wakey people!!”

All of that said, it is a major help that a scholarly old judge has shared his thoughts on civil disobedience and the dangers for democracy that lie ahead.   Here’s the offending video:

    I found him to be expressing an interesting personal view, though walking on egg shell’s.
    I would think, we would get a harder whistle blow off record from him.
    He was ebbing and flowing, constantly thinking about what be had just said, then colorfully reinserting his words back into political acceptance.
    It would be a completely different conversation, off record over a couple of whiskey’s.

      One of the other YouTube commenters said “He’s been got at.” I would judge that to be the correct phenomenon, tho we can’t really know. Imagine how pathetic that is. Geez.

    The Constitution of the state of New Hampshire has a Bill of Rights that preceded the federal bill of rights. Its Article 10 (known as the Right of Revolution) says:

    “Government being instituted for the common benefit, protection, and security, of the whole community, and not for the private interest or emolument of any one man, family, or class of men; , the people may, and of right ought to reform the old, or establish a new government.

    “The doctrine of nonresistance against arbitrary power, and oppression, is absurd, slavish, and destructive of the good and happiness of mankind.” Effective June 2, 1784

  11. Report an adverse vaccine reaction

    In Australia, monitoring of adverse vaccine reactions, officially called Adverse Events Following Immunisation (AEFI), is by way of passive surveillance, ie. initiated by the reporter. It is estimated that less than 10% of adverse vaccine reactions are ever reported.
    What is an AEFI?

    The Australian Department of Health defines an AEFI as any serious or unexpected adverse event that occurs after a vaccination has been given which may be related to the vaccine itself or to its handling or administration.

  13. Regarding the words of Lord Jonathan Sumtion…

    This guy is a classist and a lawyer.

    As far as I know, anybody who has studied resistance movements and revolution in history, always draws a common conclusion; Never trust a lawyer. They will always let you down, invariably at the last crucial minute.

    Being long aware of this axiom, I pondered the phenomenon and concluded that:

    Anybody who has a predeliction to impose strictures on human behaviour, (ie wants to study law), has a socio-psycho precondition.

    Secondly, anybody who suffers three years of law degree, is irretrievably indoctrtnated into hierarchism and is forever incapable of accepting genuine democracy.

    This was one of only two classes of humanity that William Shakespeare condemned: Askenazim ‘Jews’, and lawyers (“After the revolution, get rid of all the lawyers”.
