The FDA’s “Authority” in Medicine Is Pure Bluff. But Recall Jeff Bradstreet

A new case has come forward, Nowacki v Gilead Science, in a Michigan state court. The plaintiff claims that the Pfizer vaccine contains contaminants.  This case has not been dismissed!  It’s not a claim for injuries received. Therefore, the vaccine manufacturer does not get the immunity from liability per the 1986 outrageous law known as the NCVI, the National Childhood Vaccine Injuries Act.

Someday I’d like to write a list of false justifications that Congress has given for passing outrageous laws. For the NCVI, it was the idea that vax manufacturers would have to go out of business if they got too many lawsuits, poor things. Bill Gates later said his returns on vax is twenty to one.  (Even if there had been a chance of the vax makers quitting, the nation could have done that job by contract, just as they could replace Boeing or Raytheon in making weapons. Did no Congressperson ever think of that?)

But for today, I take up the matter of FDA, with an eye to reviving the case of Dr Jeff Bradstreet (1954–2015). He was a superb physician who had an autistic son. He was working on a cure for autism and feared the threats he was getting from the FDA.  A few days after that agency raided his office, he was found dead, having been shot and thrown into a river. Police called it suicide.

Lemme tell you something: doctors who are working on a cure for something don’t commit suicide.

History of the FDA

Here follows a brief recap of the laws related to the FDA, Food and Drug Administration. It does properly have a mandate to protect consumers both from bad products and from labels that misrepresent what is in the package. After that I will analyze the unconstitutionality of much of what the FDA makes bold to do today.

In 1906 Congress passed the Pure Food and Drugs Act. It forbade interstate transport of impure meats and other foods. The mode of enforcement was the right of the government to seize products that broke the law. This fits properly under Article I, sec 8, Clause 3 of the US Constitution, known as the Commerce Clause, which gives Congress the power “to regulate commerce with foreign nations and among the several states….”

The 1906 law also required accurate labeling of the contents of packaged food. One of the contents may be heroin, which was not illegal. The point was to make the packager ’fess up as to what is in the package so the customer knows what he is buying.

Does the law apply to packaged food wholly produced and sold within a given state? The courts have varied on this. Early on, Chief Justice John Marshall emphasized the idea of commerce ass “traffic.”  Later, in the Swift case, the court said the feds could interfere in state sales of cattle. Today, almost anything supports federal intervention, including in gun sales. But see the 2000 Morrison case with a dissent by Justice Thomas. He wrote:

“Until this Court replaces its existing Commerce Clause jurisprudence with a standard more consistent with the original understanding, we will continue to see Congress appropriating state police powers under the guise of regulating commerce.”

Yay!

In 1938, during The New Deal, Congress passed The Food, Drug, and Cosmetic Act. The push for it came from a disaster in Tennessee in 1937 where 100 people died from using a sulfa drug called Elixir Sulfanilamide.

Note: I do not rule out that the disaster was planned for the purpose of passing this law, as Congress had heretofore resisted any extensions to the Food and Drug Act.

Government inspections at factories then became be part of the enforcement. (I’m guessing that this “justified” the raid on Dr Bradstreet’s office.) Also, the 1938 law opened a new type of legal restriction — on the manufacture of a medicine that was bad for you.

And who could decide what was bad for you? For any new drug, the manufacturer had to get “pre-market approval” from the FDA. You may think the FDA inspects the product scientifically to see if it is “safe and effective.”  Nope.  It lets the manufacturer present the evidence for that, and then approves it. There is no independent critic in the halls of the FDA.

In 1951, the “Durham Humphrey amendment” to the 1938 statute brought in the idea of a drug that could only be purchased with a doctor’s prescription. Of course this increased the powers of the medical profession.

It has to be noted that by the 1920s the medical profession was largely controlled by the Rockefellers. They put their men into the American Medical Association, via state branches, and they influenced state rules of accreditation of medical schools. All new graduates by 1940, in my opinion, were Rockefellerized. They treat patients mainly by writing prescriptions. Then came pressure form mega-pharmaceutical houses to eliminate treatments that didn’t use drugs! Wow.

In 1962, Congress passed the “Kefauver Amendment” to the 1938 Act. This stemmed from the disaster in Germany and UK, where many children were born with short limbs after the mother had taken Thalidomide. The FDA had not approved it for importation to the US, hence American kids were spared.

I have made the claim in my 2013 book Consider the Lilies that the Thalidomide disaster was deliberate. I also say in my 2023 book, Society Is the Authority, that our FDA may have been in on it. I also think the 1942 disaster in Boston known as the Coconut Grove Fire, is suspicious. 450 people died. There was massive media coverage which followed the fates of the survivors. Those who were given antibiotics – which had only become available in 1941 – recovered.

I realize that my saying such things is outrageous.  However, if my guesses are correct, the real outrageousness lies not with me but with “them.”

Note: In 2022, the parties in the Opioid case settled. Thousands had died from overdosing on this addictive substance, as its creators could have predicted. No perpetrator has been punished. Some businesses received fines. For example: CVS Pharmacy will pay up to $4.9 billion over 10 years; and Walmart will pay up to $2.7 billion in 2023. And what does the Opiod tragedy tell us about the value of the Food and Drug Administration? Did its rules protect young people from death?

In 2022, Congress passed the FDA Modernization Act 2.0, which allows the manufacturer to skip the stage of animal-testing in new drugs. I guess that’s a happy deal for the animals.

The FDA’s Involvement in Medicine is Unconstitutional

The United States Constitution is very easy to read. Consider Article I. When the delegates sat down at the Philadelphia convention in 1787 to construct a constitution, they did so as delegates from 13 already existing states. They chose to yield some state powers, but not many, to a new federal government.

Article I, Section 8

In Article I, section 8, they granted Congress the power to legislate on various things that logically should be national, such as coining money (Clause 5) and raising an army (Clause 12).  You wouldn’t want to have the people in each state using a state-based currency, and you wouldn’t want to have 13 state armies.

Where is the clause that assigns Congress a power to govern health as such? There is no such clause. By a big stretch, you could find it in Clause 1 that permits Congress “to lay and collect taxes… to provide for the Defence and general welfare of the United States.” But the word welfare at that time did not mean what we now consider to be welfare. And anyway, no constitutional scholar or court has tried to make Clause 1 the basis for a federal health power.

Which clause allows Congress to legislate on the subject of examining the purity of food and drugs?  There is none, as such.  I suppose Clause 5, at a stretch, could encompass this. It says Congress shall have power to “fix the standard of weight and measures.” Let’s say there was a label such as “cheese” that merchants were applying to various food products. Folks would appreciate having a national definition, so they could be sure what was in the package.  But again, there is no argument (that I know of) for basing an FDA authority on Clause 5.

The best bet is Clause 3, the aforementioned “commerce clause.” It permits the feds to regulate commerce. To repeat, we are looking at “section 8” which lists 18 clauses that grant powers to the feds as opposed to the states.

Finding the Authoritative Interpretation of Section 8

In order to find out what the Framers of the Constitution had in mind – way back when — you can go to two excellent sources.

The first is James Madison’s Notes – a sort of Minutes of the Meeting of each day’s session at the 1787 convention. (These are printed in a marvelous book entitled “The Founders’ Constitution.”) The second source is the public “Ratification Debates” in each state that led to the acceptance of the US Constitution in 1788. My Personal Stance

Being a strict constitutionalist, I am very opposed to Congress’s acting ultra vires, that is, beyond its power. My personal experience tells me that the Legislature is tightly controlled by the Powers That Be (i.e., wholly unauthorized persons). It passes laws that it has no right to pass.

Many citizens, including myself, have filed challenges to Congress’s practice of NOT grabbing ahold of its power, to declare war, as mandated by section 8 Clause 11. Instead, the Legislative branch lets the Executive Branch get away with making wars – exactly what the Framers tried to guard against. I honestly do not think our 435 representatives and 100 senators give a damn about the parchment. See my book, Prosecution for Treason, aimed mainly at Congress.

Worse, the Judiciary, too, is under control of the Powers That Be. Shouldn’t the judiciary have tossed the Patriot Act to the winds, based on the Bill of Rights?  Of course it should have, although it may properly say that it did not have before it a specific case.  The US Supreme Court is not permitted to make policy, it can only adjudicate a case. But it has had many chances to stick up for our rights and has not done so. In the 2010 case, Citizens United v FEC, the top court openly took the part of the Powers That Be.

Openly, I tell you.

Of course my objection to some federal “meddling” in science or medicine does not mean I can’t see the value of supervision. For one thing, the 50 states can meddle – they don’t have the kind of limits in their constitutions that would make them keep hands off Medicine.  Plus, our Constitution-making did not end in 1787. Article V allows amendments and indeed there have been 27 amendments; the most recent one is dated 1992.

Plus there can be national institutions run by the people. I can easily imagine one on the topic of vaccines, indeed Steve Kirsch has founded one in California. The people have every right to make recommendations as to which ingredients should be kept out of vaccines, or at what age a vaccine is appropriate.

At present, the National Institutes of Health do not qualify as people’s institutions. Besides the fact that there is no constitutional mandate for the feds to appear in medicine (or education), the NIH have used “funding” to alter the ability of academics to do original, creative research. Happily, the Fauci performance, outed by Senator Rand Paul, may lead people to kiss the NIH goodbye.

The New Case

Since October 2023, we have Nowacki v Gilead Sciences, in which a plaintiff was “allowed to sue a drug manufacturer.” I mean, the judge in a Michigan state court did not dismiss it.  (He had better check his brakes tonight.)

One can’t help calling that judge a hero, but under the Bill of Rights, every person has a right to bring a lawsuit for damages against the party that harmed him.  Per Amendment VII:

“In suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise reexamined in any court of the United States, than according to the rules of the common law.”

Well, the Nowacki case just goes to show you that the situation is changing. Thank God. And many articles on the Internet will see this case as helping us throw off the ridiculous tyranny of Covid.

Hampering Doctors

To repeat, under the Constitution’s Article I, sec 8, Clause 3, it’s reasonable for federal authorities to prohibit interstate transport of “bad stuff.” I think the definition of bad stuff can include mislabeled products and contaminated food, per the 1938 Food, Drug, and Cosmetics Act. Citizens deserve police protection and it’s too hard for states to reach across a border to capture the maker of bad stuff. Let the feds do it, under Clause 3, in their role of regulating commerce.

But as to the supervision of health, it is wrong for the feds to have any say whatsoever. I have been told that most doctors do not realize that the FDA has no mandate to tell them what to prescribe or not prescribe. Granted an FDA statute seems to give it a power to “approve” a new drug, but this is a bad joke. And as for the FDA telling doctors what to prescribe, this just does no happen. The FDA “seems” to advise, but when it does so it is acting ultra vires.

In a later article I will discuss the deaths of three doctors – among many – who bucked the system. Namely, Nick Gonzales, Rashid Buttar, and Jeff Bradstreet. For now I say we need to stop this intimidation and persecution of doctors.  Even as we speak, many doctors and nurses are suffering for having done the noble thing during the pandemic.  What a disgraceful world we live in.

Note: The CDC and the WHO are also lack any constitutional authority.

    Did not look into it, but I have little doubt. The speed and depth of the act, is the usual marker. Could be here, they re introduced. Little to no doubt.

    No new laws were needed, it was either murder or an accident. The bigger the accident that can happen, in theory, the bigger the class action. Murder could be by an individual that have different defined remedies. I’m not an expert or even an armchair amateur, but crime gangs had been dealt with by law even before RICO laws. Dead or alive.

    You can’t find a healer even a quake, why not. Doctors have credentials and as long as they are not impersonating, whats the problem. You can suicide by MD system or even take your chances with an EUA type solution.
    The MD system is a cartel of associated crime gangs and the bosses need to be identified and taken down by RICO. If they try to abscond, go old school

    • The last thing you want is the UN security council ruling. Its pretty clear they are only interested in maintaining a balanced conflict. They could not be more wrong than they are and their peace keepers are pretty much animals.
      They have been destabilizing the world for wealth extraction from the get go. I don’t think they have had a lasting peace. They only step in to help one side rearm or ban weapons to the stronger side.
      They have spent a lot of time in Lebanon but none in Israel. Lots of condemnation for Israel but never sanctions.They live in Cypress but that’s something else

        It was on a CNBC breaking news program titled,
        “Pfizer CEO: Optimistic about reaching dosing goals.”

        When asked if he was getting the shot by interviewer, he said he didn’t get it because he knew it was poison.
        Pfizer has been fined over 5 billion $US past decade for marketing dangerous drugs.

As long as they roam with impunity they will do incredible damage. They push that our immune systems are ineffective and the only cures are their jabs. If people simply turn of the TV, look around for proof of a pandemic, they see bs for what it is. Tragically, people believe the screens more than reality.

    The agenda for the jabs is connection with the matrix AI and mass murder committed from afar with a sinister stealth weapon, as the perpetraitors remain anonymous and protected. They belong to the same club, and we ain’t in it. Thank God for that.

    • In a mighty victory for the stoopids this anti-va666 politician was rejected, at the last election, or perhaps rigged out of contention by some crooked voting system.

      bit of good cop, back cop for credibility. I will stand corrected should the security council issue a resolution against Israel to cease fire and withdraw. Non compliance to follow with sanctions. That resolution would be reasonable, if the narrative is true but they would play the veto game to protect the UN and Guterres reputation. The UN has access to many intelligence sources, but if you look back they are just morphing with the narrative i.e weapons of mass destruction- resolution – sanction – dead children – oil for food. Turns out those few US weapons had been neutralized per resolution.

    • They just wont stop with these “storys” . This one looks to target vets with mental history(well that would be common in ex combat). These people have the experience to get on the tools. Usually a “assault” AR leads but not here. FBI is on the hunt, why, aren’t they just for investigation. FBI is never far from a patsy.

      • Took a bit of planning, the Mayor has practiced acting, the part. He might be a smooth fox usually, but if people you knew were minutes ago almost shot by looks a small bore AR with a few whistles, think the Mayor would show a bit more emotion(why are security cameras often grainy- gunman looks the part but he would).
        The officer relaying events to the news, just too “timed” this is a unfolding situation, and like clockwork the story unfolds like script. Starts with mental threat of shooting up a National Guard facility. — that sounds familiar, google news back the years they happen a lot. Maybe the vets come back for revenge at a recruitment facility, but after a few times .. I think it is like a script tool, for subtle reinforcing of wanted narrative direction. Like the Mayer it happened, I was there. Sure but just in a ‘on set” way.
