Tamerlan Tsarnaev, and a sealed document

There has been a very exciting development in the Tsarnaev case. I got this news from a friend of Josée Lépine, who has spent every penny she can spare purchasing court documents. (You, too, can impoverish yourself this way, regarding any federal case, at PACER.gov)
The new piece of vital information came in a release of court documents that were, until now, under seal. That is why I’m thanking Justice O’Toole, as it does appear – incredibly — that a judge has so much discretion that he can withhold, or release, any document in the case.
George O’Toole is a justice of the of federal district court of Assachusetts. (I’m calling it that until Jahar’s case is properly adjudicated). The good judge has now released an amazing motion that was filed in court by the defense team. It shows that the government was surveilling the older brother Tamerlan in 2011.
Originally O’Toole withheld more than a thousand documents. This meant that the public could not use the information contained therein in its evaluation of what was happening at Dzhokhar (Jahar) Tsarnaev’s trial. That media-hyped trial ran from March to April, 2015, two years after the Marathon bombing.
You may ask why the public’s involvement matters. Here is the best example. (Well, second best, the suppressed amicus brief sent by Maret Tsarnaeva has no equal.) The public’s awareness of the FBI involvement would prove to the public that the FBI lied from Day One as to its own “innocence.”
The prisoner should have been set free at that point. And should be now – preferably before lunchtime.
Stings and Pseudo-stings
I mean the document changes everything. Let me begin by hypothesizing that the whole affair was an FBI operation. I don’t mean a sting, although FBI stings are famous. I simply mean the FBI or its contractors (or Homeland Security or FEMA or CIA or anyone of the agencies that US citizens pay to harm them) planned and carried out the bombing.
There are now at least 20 cases worldwide where a “Muslim” was said to have caused many deaths through a “terrorist act”, and where the investigation is so full of holes that it’s apparent to all but Wilfully-Blind Freddy that the authorities have much to hide.
Those cases rarely get to court, as the script typically includes that the killer “turned the gun on himself.” (In Australia’s Port Arthur case, the patsy “burned his house down with him in it” – almost.)
Jahar Tsarnaev, hiding in a boat (probably coercively drugged) had 228 bullets – that’s the police’s official count — sent at him. I’m sure this would have been described in the media as “He died in a shootout with police” – except he managed to survive!
Consider what might happen if a patsy, or a sting-ee, actually made it to court and found an honest judge. Well, it did happen. In the case of Amanda Kolody in Victoria, BC, Canada, Justice Catherine Bruce acquitted the two accused because it was a sting.
She showed that the two Muslims were drug addicts who were “incapable of plotting to blow up the legislature building.” Oh, Lord. Honesty is so rare these days it is positively thrilling to hear it.
New Life for Bostonians
The document-release by Justice O’Toole has of course come too late to prevent Jahar’s conviction, but it’s never too late to tell the truth. The case is currently in appeals.
Now every person who watched Richard Deslauriers play-acting on TV can have a quiet reflection as to his or her own gullibility.
On April 16, 2013, Boston’s FBI chief Deslaurier called a big (bully-ish) press conference to say that there were not yet any suspects in the case and that the public should help out by donating their amateur videos films of the Marathon finish line.
Total garbage. They knew Tamerlan for years (indeed his Mom said so, but no one listened).
Talking to the FBI
I am eager to speak with two FBI guys, John Foley and Kevin Swindon. They are interviewed in a Youtube video, standing near a three-dimensional model of the Boylston St area. They show how authorities (read: criminals) figured our where the bomb had exploded.
These guys say they then searched scads of photos for the owner of a backpack, which was (according to a very dubious photo) on the ground near the damage.
I want to tell John and Kevin that I give them the benefit of the doubt up until this point. That is, I will grant that their FBI bosses prepared a scenario for them that seemed believable. They were told “we don’t know whom we are looking for.”
But now that the lie has been exposed, concerning just that one item so far, Swindon and Foley will be required to rethink. Did the bosses lie to them also? Were Swindon and Foley told (after the name Tamerlan Tsarnaev came up) that the FBI had no familiarity with him?
The FBI’s Job
Here is what the official “Federal Bureau of Investigation” website says:
“Operating under the jurisdiction of the U.S. Department of Justice, FBI is concurrently a member of the U.S. Intelligence Community and reports to both the Attorney General and the Director of National Intelligence. [Note: No man can serve two masters.] …
“Although many of FBI’s functions are unique [I’ll say!], its activities in support of national security are comparable to those of the British MI5 and the Russian FSB. [I’ll say!] …
FBI is primarily a domestic agency, maintaining 56 field offices in major cities throughout the United States… At an FBI field office, a senior-level FBI officer concurrently serves as the representative of the Director of National Intelligence.”
As for the document that has recently come to light, namely a MOTION FOR NOTICE OF USE OF FISA OR OTHER SURVEILLANCE, as written by the Defense team of Jahar, it says:
“A report by the House Homeland Security Committee released on March 26 suggests that government agents monitored Tamerlan and his communications during 2011 and perhaps 2012. According to the report, the FBI Joint Terrorism Task Force in Boston conducted a threat assessment of Tamerlan in response to a 2011 alert from the Russian government.”
It is clear to anyone who has two working eyes that the FBI murdered Tamerlan in custody. Such things are not in the job description. I mean they are not in the public version of the job description. Tamerlan had to die, and younger brother Jahar had to almost-die in the boat so that Bostonians would not hear the Tsarnaev’s side of the story.
So Talk
I mentioned that Aunt Maret told the correct side. She (in her thirties, with a small child) has been incommunicado, in Russia, for a while. The person who is not allowed to talk in America is Jahar himself, who is under Soviet-quality restrictions in a prison that is already Supermax.

Boston citizens, are you getting sick of this routine up there in Assachusetts? Then start talking. Just hold a meeting on the park benches at the top of Castle Island next Sunday at 2.30pm and ask each other:
“What should we do, now that the revealing document has officially been “declassified? It shows that we Beantowners were made fools of. Let’s ask some nice lawyers or police what the options are.”

Anyway, congrats to the judge for doing the right thing. “All is forgiven”. Well, I mean a little bit is forgiven — and a lot more can be forgiven if you will come out of the closet before Thanksgiving, Your Honor, and give us stuff to be extremely thankful for.

Dee, at around 3.20 minutes in this video, the quality of the Podstava picture is poor. But it wasn’t poor the day you edited it in your studio. It was clear and I still have it — a clear copy — in my home. Apparently it has been fiddled with. So one day, we can re-insert it.
The point, for any newcomers, is that the 26-year-old Tamerlan was arrested, taken into FBI custody at that moment (wee hours of April 19) and murdered. The entire story of the shootout is false. “Brother ran him over with an SUV.” Nonsense.
This is such important information, but I for one won’t be thanking O’Toole any time soon. He did everything wrong and conspired to have an innocent teenager sent to death row. He should be in prison.With this new information, I believe the photos of the brothers at the marathon, gas station, boat etc, are likely pictures taken in the past before the marathon and inserted into the official narrative. People don’t change their looks so drastically in the course of 3 days. I will have more on this in the near future. It’s all becoming so clear now.

I urge everyone to read those court documents, and if you have done so, read them again. They make much more sense now that the trial is over. You can now understand why the defense asked such and such questions when crossing government witnesses.
This case is frankly fascinating.
Mary, when did this latest information break. I ask, because in the last few days there has been a virtual mutiny within the ranks of the FBI by underlings in regards to the investigations into the Clinton crimes. It looks like there is going to be a major shake down in the U.S. in the immediate future. May be our learned friend has become worried about his past position.

Mal, Yours Truly has interpreted the “document” with a touch of poetic license. I don’t really think it carries the weight i assigned to it as an admittance of FBI naughtiness. (That was a pro-Jahar move on my part. Anything that can be gleaned from the court documents that show bad COURT behavior is very telling, no?)
Still, I hope Mal is right that cops and spies are now seeing that they married into a family they did not understand. I hope he’s right that Big G will start to worry. These are exciting times.
Now let me mention the document that I used with poetic license. Under the FISA laws — which Congress passed a few years ago despite the sacredness of the 4th Amendment —
(the amendment in which the Founding Fathers said “Don’t search my underwear at airports,” even tho there were no airports in the 18th century, if you know what I mean)
— an accused person must be told, when preparing his defense, that the prosecution is going to use “surveilled” stuff.
Judy Clarke, on whom I have perhaps been too harsh, “moved” — i.e., made a motion to the court — for Jahar to be given what he was entitled to under FISA. George did not respond to Judy as he should have. He allowed the Prosecution to reply with gobbledeegook. (Josee Lepine flips through these court documents and picks out the miscreant ones — don’t give me credit.)
The fact of US admitting that they had surveilled Tamerlan in 2011 came up as an aside within this doc. It refers to a Congressional committee that released that particular gem.
I then jumped on it because it makes Deslaurier look bad and it is essential to make Deslaurier and the entire murder gang look bad. Hey, their official HQ is an a building called “The J Edgar Hoover Bldg.” Does anyone need more incrimination than that?

Dear Fish, I tend to think the Russian “warning” is a red herring. Do you rcall the Bojinka thing? Many planes to be hijacked all at once from the Philippines? i think it never existed. And I suspect all parties including Putin are run by the same masters.
They say a better test of Tamerlan’s “dangerousness” is the fact that he wasn’t no-fly-listed when trying to leave the US, and ws not even called in for a chat upon return. Poor patsy.
The person who left the back pack with the bomb in it was identified very shortly after the incident by video footage. The bomber was an employee of CRAFT. One of those wonderful contractor to the U.S. Government. No other evidence is required.
This is very good news. Is there anything that festers like rank injustice and corrupt ‘law enforcement’ organisations? Gradually the ‘layers of the onion’ are being unpeeled, leading to the very top echelons of the United States Government, prepared to do any criminal act, to further its wicked global agenda. Tom, you mention a “second jury.” How will there be a second jury? By the way, somone once commented at GumshoeNews, but I never heard further, that the original 12 jurors, or at least some of them, had not “signed the paper” for the death penalty.
A second jury of new people is what is needed not chosen by the feds. Yes Some are against the DP so they didn’t sign it.
Please tell us how you know that some people did not sign.
Mueller originally said in 2013 that he had visited the Mosque that Tamerlan attended as part of an ”outreach program” though I can not find the original document;

Even if the FBI admit they had the Tsarnaevs under surveillance (I highly doubt they will) I do not see how it could help Jahar because they can still say that he did the bombing. Who knows if it would even make the news.
Of course it wouldn’t make the news. The media would never report such a thing.

Yes, it would have been difficult, which makes it highly unlikely that the brothers did it. However the FBI could still make it seem like they did it, which is what many people believe is exactly what happened. The “outreach” program is just another word for paid provocateurs or informants, who try to provoke others at a mosque to become radicalized so the FBI then can set them up and then arrest them for some fake “terrorist” plot.

The sentence you quoted means of course that the boys “would have been blocked from doing their pressure-cooker fandangle if “we” had kept a proper eye on them.”
It does not mean someone stood up in Congress and said

I don’t believe Tamerlan was “radicalized” at all. I think he may have been paid to do some things that the FBI probably told him would “help them out,” like keep an eye on other Muslims at the mosque and report on anyone who may be a potential terrorist or even something more benign. And they also may have threatened him into cooperating. This is something that happens to Muslim immigrants all the time as I understand it. Tamerlan was probably being harassed to some extent and agreed to cooperate (or pretend to cooperate) so they’d leave him and his family alone. And all the while the FBI was setting them up as patsies. It was one of the most blatant acts of “government” crime that I’ve ever seen. All the talk about Islam and terrorists, etc., etc., is propaganda meant to make Americans believe there are lots of scary Muslims out there in the big scary world who “hate us for our freedom” and that we need more and more “security” to “keep us safe.” Meanwhile, every single act of “terror” in the U.S. and abroad has been staged. The idea of ordinary Muslim immigrants in the U.S. becoming “radicalized” and wanting to kill Americans is just nonsense. In the last week or so we were told that there could be an attack in New York, Virginia, or Texas on election day by Al Qaeda. Don’t you think it’s interesting how they know who, when, and where attacks might take place, but can’t do a thing whatsoever to stop it?
Speculator, you are absolutely right. I don’t believe Tamerlan was radicalized. I believe he was harassed, spied on, and blackmailed into doing what the FBI wanted him to do, and he complied on the promise of getting his US citizenship, not to mention money, which he needed to support his wife and child.
The FBI has no real job, only the pathetic and cruel job of creating false terror attacks, and ruining or taking away innocent people’s lives.
Dzhokhar on the other hand, had no part in anything and was the farthest thing from a devoted Muslim. He was totally innocent, just a normal teenager who is now suffering in every way, so the FBI can be sure to keep their secrets safe. The only thing the people in the US need to be afraid of is the FBI.

A few days ago Edward Davis former Boston Police Commissioner who was involved in the investigation of the Boston Marthon bombing said the following:

Krause then asked Davis how he sees the threats of ISIS changing over the next couple of years. Davis spoke about U.S. strides in crime control after Sept. 11. After the terrorist attack, the U.S. responded again by passing bills, including the Patriot Act.
Davis also commented on the Boston Marathon bombing and said that he does not believe anyone could have built the bombs with just instructions from the internet, as the media reported.
“The terrorist brothers Dzhokhar Tsarnaev and Tamerlan Tsarnaev] had to have had real, hands-on training,” Davis said. “There are a small number of people who are radicalizing things and getting people to do things just by a remote control.”
WOW. One year and a half after Dzhokhar has been sentence to death for constructing or conspiring with his brother Tamerlan to construct those bombs and after we learned from the trial that the brothers were lone wolfs and that they had no ties, relations, communcations with terrorist groups, we learn that Davis does not think the brothers constructed those bombs.
Very strange thing for Davis to say. Do you suppose he wants us to think (1) that the Tsarnaev brothers were being coached by some terrorist group after all, or (2) that the FBI was coaching them? These are the only things I can think of right now that would lead him to say this. I’d lean towards (1) because he knows the truth. There’s no way he could not know that there was no evidence against these brothers and that everything used as evidence was concocted and/or created by the FBI/DHS/CIA, etc. He couldn’t possibly not know that the whole incident was staged and that the “bombs” were not really bombs designed to harm anymore, but were just smoke and noise.
