War Powers Case , Maxwell v President of the United States, Is in Appeals

In November, 2017 I filed in United States District Court for an injunction against Trump’s war plans, as it is not legal for him to wage war without Congress’s say so. The case was dismissed by Chief Judge Laplante in New Hampshire in January, so on February 2, 2018 I appealed it to the 1st Circuit Court.

I asked my friend Hummux, owner of 911TV.org, to film me reading the text of my appeal “in case anything happens.”  The video is now uploaded if you care to watch it.

Note: a soldier, Captain Nathan Smith, has a similar case in appeals at the DC Appeals Court.

(I want to say “the DC Circuit” but the judges of that court do no need to ride horseback anywhere to attend to disappointed litigants.)

The other case started out as Smith v Obama, but after the Inauguration the name of the case was changed to Smith v Trump. Mine is called Maxwell v President of the United States. I have told the court that although I am overseas I can appear on 72-hours notice if they require me to present oral argument.

There is a boo-boo in my reading of my appeal. At 10:20 minutes into the video I say “If Congress grants an injunction “   Of course I meant to say “if the Court grants an injunction.”  (But it is written correctly in the document.)   1. I wonder if the pendulum is beginning to swing back to a more moral society and if so how long will it take. Mary you are our champion, doing nothing is not an option and to press them to act morally using their language is correct action.
    Time will show.

  2. Since I realised what really happened at Port Arthur and on 9/11, I have no faith in the Law at all.

    I cannot understand how a legal citizen of the US can be said to have “no standing” to bring a case to court in the US. If they have “no standing” who does apart from dual citizens of US and Israel?

    In any case, It should not make a scrap of difference whether a person has standing, once a crime against the Constitution is brought to the attention of the Court, that court should be obliged to act.
    As I understand the situation, a judge on appointment, swears to uphold The Constitution.

    • Thank you, Mal. It is codified at 28 USC 453:

      Each justice or judge of the United States shall take the following oath or affirmation before performing the duties of his office: “I, ___ ___, do solemnly swear (or affirm) that I will administer justice without respect to persons, and do equal right to the poor and to the rich, and that I will faithfully and impartially discharge and perform all the duties incumbent upon me as ___ under the Constitution and laws of the United States. So help me God.”

      Fancy that: without respect to persons.

  4. Mary’s appeal to Materialistic “Evolutionary” origin and justification for such concepts as morality and law is a supreme example of putting your head in the noose and chopping your own legs off.

    If random chemical accidents, struggle for survival (and supremacy), is ratified by “natural selection” (survival of the fittest), then the only “evil” is failure and the only “good” is success. As such, any one (or group) who can usurp and control culture and government will (must) do so because that’s “Evolutionary progress” according to Materialistic dogma. Protests against is little more than the plaintive bleating of deluded fools who dismantled the fort erected by Divine Providence and defended by the wise and holy.
