This War Is a Mistake. A Panel of Elders Can Call for Its Cessation

Today, in the US, I am anxious as to what will happen next, and I assume the majority of Americans – and Iranians — are similarly worried. Missiles are flying and there is even talk of a nuclear bomb by US, Israel, Russia, or some other party. Who can step in to stop this madness?

I propose that a Panel of Elders do this. That came to me while I was watching yesterday on Judge Napolitano’s podcast, some thoughtful remarks by two retired US Army colonels Karen Kwiatkowski, age 65, and Douglas McGregor, age 79. The judge’s age is 75. All three of them (and myself, age 79) are taken aback by the lack of any debate as to our nation’s attacks on Venezuela last November or, today on Iran. This article sets out what a Panel might do.

A Fictional Panel of Academics

Start with a fictional case. Let’s say that an African nation, Kenzo, is at war with a South American Nation, Urugu. Say that Kenzo is the aggressor, or at least fired the first shot. Many people in each of those two countries will suffer, as will people in countries far away – for example due to ecological damage or cessation of trade.

Now pretend there is a Panel of Academics from departments of history, law, botany, and psychology. Their chairman, a Scot named Bruce, goes to the podium and says “Would scholars please make suggestions as to what our Panel should be looking at, in order to judge if we should advise the Kenzon’s to “withdraw their troops.”

Up jumps History professor Alice, and says “We should make comparisons to past wars. We would then be able to see what makes for a successful war – e.g., the strategic use of allies, the ability of Urugu’s troops to find food and ammo, the necessary motivation for guys to sacrifice their lives.”

Quickly, Law student Dave says “No, wait. That’s diving in at the deep end when action is raging. We need to step away and look at the law. Did the Kenzon’s have a treaty that allows or forbids warring with the Urugun’s? Pacta sunt servanda – treaties must be kept. See the Vienna Convention, and the UN Charter’s Article 2 against invasions.”

“Keep your shirt on, Dave,” cries Botany whiz Ebenezer. “Law isn’t everything. There’s Nature, which has its own law, as we saw when the tsunami hit Japan in 2004. A wide war entails crop failures and diseases.”

Chairman Bruce grabs the mic. “Panelists, the point is not to have one’s particular academic perspective prevail. All views are needed.”

Madeleine, professor of Psychology, asserts: “And not just academic perspectives but the psychology of the players. Look into Urugu’s government. Do some Cabinet members have a personal financial interest in warring? Are some of them covert operators for an outside organization? Or, among the Kenzo folk, is there a strong belief that a divine Being is ordering them to wipe the Urugu’s off the map — and if so, why?

I Say “Stop the War!”

Dear Reader, what is your feeling as to what we should be looking at in regard to the current active war between United States and Iran? Would you wish to cast a vote “Stop” or “Continue”? Have you got skin in the game – e.g., you’ve been planning a June trip to Rome but now see that a lack of jet fuel may cause airlines to shut down? Are you worried that as a Democrat or Republican you might be ostracized by your Party for saying the wrong thing? Maybe you are pregnant and spooked by what the war’s consequences might be for your baby?

The Panel of Elders that I propose cannot, now, take the time to evaluate the US’s chances for victory. Its members already see major reasons for stopping the war immediately, irrespective of the conduct of the war or any motives behind it. The top five reasons are:

1. President Trump can’t be trusted with this huge responsibility. He changes his story about the war every few hours and is almost comically known for telling lies.

2. No US president has constitutional authority to start a war without Congress having first declared war.

3. The Secretary of War Pete Hegseth should not have been appointed to this job as he is an alcoholic. (How can officers obey him blindly if they think he is indisposed?)

4. Congress has deserted us, refusing to insist on the Legislative Branch’s part in war-making.

5. The US has always promoted, worldwide, the deterrence of nuclear war, but is now courting danger — Iran, Russia, or Israel might go nuclear. The US would no doubt respond by using nukes, completely against our national policy.

The Panel of Elders

That’s enough, for the moment, to call for formation of an “off the books” group. Its members take those five reasons as sufficient justification for urging a halt to this war. When a person notices that something outrageous is about to happen, it is normal to try to do something — anything – that could act as a preventative.

Personally, I have already tried three ways to protest the Iran war. One is by going to federal court on Feb 20, 2026 and filing case number 26-cv-061, asking the judiciary to make a Restraining Order against a hit on Iran (that was a week before the first attack). Two is by hand-delivering to my Congressperson’s office, on March 16, some suggested Articles of Impeachment of President Trump: on Venezuela, on globalism, on Iran, and on obstruction of justice. Three is by writing, at Substack.com, some legal objections to the Iran war.

Over the years I have made similar Lone Wolf efforts, but realize they are near-hopeless. I now ask for some Oldies to join me as a Panel. This way, their opposition to the Iran war does not get obliterated by a personal attack on them (which is so easy for a smearer to produce!), or by categorizing them ideologically. Citizens, who are loathe to side with one spokesman, might happily side with a Panel whose members claim to speak from a position of Reason.

If you wish to nominate someone to serve on this panel, someone who can accept all of the above 5 reasons, please contact me at MaxwellMaryLLB@gmail.com. He or she must be already established with the public as a trustworthy and reasonable person. I recommend a minimum age of 60 but it’s not mandatory. Must the person be a US citizen? It’s preferable but there could be exceptions. Is it OK to nominate yourself? Of course.

Do We Incite Mutiny? Is It a Crime?

By its very existence, as a panel demanding an end to a war that the President wants, would panelists be committing a crime, such as sedition or incitement to mutiny? Everyone knows that you can’t run a battle without perfect teamwork. Mutiny is punishable for military personnel under a 1950 Congressional Act known as the UCMJ, the Uniform Code of Military Justice, whose enforcement is done by courts martial. Per a 1956 edition:

(a)Any person subject to this chapter who—(1) with intent to usurp or override lawful military authority, refuses, in concert with any other person, to obey orders or otherwise do his duty or creates any violence or disturbance is guilty of mutiny;

(2) with intent to cause the overthrow or destruction of lawful civil authority, creates, in concert with any other person, revolt, violence, or other disturbance against that authority is guilty of sedition;

(3) fails to do his utmost to prevent and suppress a mutiny or sedition being committed in his presence, or fails to take all reasonable means to inform his superior commissioned officer or commanding officer of a mutiny or sedition which he knows or has reason to believe is taking place, is guilty of a failure to suppress or report a mutiny or sedition.

(b) A person who is found guilty of attempted mutiny, mutiny, sedition, or failure to suppress or report a mutiny or sedition shall be punished by death or such other punishment as a court-martial may direct.

Does the above apply to civilians? No, and the only veterans it applies to are retirees who are getting pay after 20 years of service. Even if the UCMJ were applicable I suppose it could be argued that the ‘crime’ here of un-declaring war is not a crime since the taking up of the Iran war was unconstitutional.

Let’s also look at “disobeying illegal orders.” Senator Mark Kelly, a former Navy Captain, made a video in December 2025, with four other members of Congress. They said (not from the floor) that “Our laws are clear – you can refuse illegal orders.” The group was opposing, inter alia, the November 2025 killing, by the US, of two fishermen (unarmed civilians) who were clinging to boats near Venezuela.

In response Secy Hegseth disciplined Kelly by lowering his pension and Trump said Kelly committed ‘sedition.’ Kelly is appealing this in federal court on the basis of freedom of speech. Meanwhile, Judge Andrew Napolitano, who is not connected to the military, recently published this statement:

​“The order to kill civilian non-combatants is an unlawful order which the military personnel who receive it have a legal and moral duty to challenge and either decline to carry out or resign from the military.”

I assume Napolitano, having been on the Bench for many years, knows that he cannot be punished for that. As to the President saying Kelly’s remark is seditious, let’s see him say the same of Napolitano. The issue would get a good public airing, which has been overdue since Nuremberg.

And what if someone does call for the overthrow of a government? We already did that via the Declaration of Independence. Now and then, two major values conflict and you have to choose one or the other. Justice Jackson once wrote (in a dissent) “The Constitution is not a suicide pact.”

It looks to me (but this is not the Panel speaking) that it’s suicidal for Americans to enter a foolish and confused war. Col Karen Kwiatkowski said, two days ago, when asked what she thought was going to happen to the thousands of troops headed for Iran, said “I think they’ll come home in coffins.”

As for the Panel needing ‘permission’ to operate, I quote the 9th right of the Bill of Rights: “The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others, retained by the people.”

Moreover, in the Constitution, people have a role in making Grand Juries. A grand jury is the entity that can indict. I’m not shy to say that a citizen-led grand jury can indict the president right now. (Again, that’s not the Panel speaking.) And just a few days ago, the US Supreme Court undid its 2025 ‘immunity’ ruling by saying that a president can indeed be arrested.

The locking up of a US president (and I don’t necessarily mean Trump) would certainly give the whole world something to think about.

    I agree with Dee that war is orchestrated, “a racket”.
    Tragically, innocents suffer on all sides since 1913.
    For love peace and understanding we the people need to sack the compromised puppets reading the vampires scribes. These bloodsuckers we never see, that’s why war continues regardless, with all marketing aimed at youth. BS propaganda telling kids that soul-diers are super heroes. Nothing else could be further from the truth. Unless the fat cat warpigs are dethroned we’re stuffed.
    Iran doubling its oil exports to China since present war started. Who benefits?

  4. All well and good, but I feel we already have a panel representing approx 195 Nations being the UN council. Where has that got the world in these never ending wars and what have they ever achieved in the way of condemnation towards any aggressor. If we as global citizens witnessed an ICC have the capacity to arrest the likes of Bibi and now Trump or any other National leader inflicting war on another nation’s territory then the solution is somewhat already there. But these wars are run from a hierarchy that are faceless and powerful immune from any retribution that have lasted over centuries.
    You really have to look at North Korea or Iran now and reconsider their paranoia in arming themselves to the extent of preparedness for a battle as we are witnessing in Iran now.

      But you did not ? (I did not read your article) widen your thought process to realise where ‘the elders’ might come from and how it could be stopped.
      You could have realised that if you had noted for the last few years what I have referred to above in the situation broadcasts…… it has been in your face all the time💁
