Some readers with legal training have requested this be posted. Juan O’ Savin (speaking from his Bentley) explains that this case is a very simple one: was the House of Representatives and the Senate, and Pence required to do the 10 day investigation that Ted Cruz requested on election tampering? To not protect the Constitution (the contract between government and the people) would be a matter of treason. Was there foreign interference in obstructing an honest vote in 2020? Did the members of Congress protect the Constitution?

My faith in courts is tainted by my experience in supporting people through the courts in Australia. We wait and see.

        Be interesting if a decision is made by midnight on 21st…….🤡 no jobs for 188 of the respondents who certified the election. Without an investigation of claimed fraud and foreign influence.
        The only members allowed back in after Christmas would be those who did not certify.
        The court does not need to rule on details of alleged fraud and foreign interference,
        It is so delightfully simple….. the Congress just did not investigate, even after being requested to, in the ten day window available at the time….. which was their duty.

For anyone who didn’t follow the story from a year or so ago, it seems this entire scenario was imagined by the writers of the original Constitution of the USA, so that if 300+ senators, congress, Resident and Vice-resident are cancelled, Trump continues on in office, the rule apparently being if less than 2 years remains of his 2nd term ( 2020-2024 or more accurately, late Jan 2021 to late Jan 2025 ) then he can go for re-election and end up with a ten year stint. Trump hinted at this long ago, before the 2020 election I think. Depending on if the caretaker presidency period ( from election day to inauguration day ) is included he might be able to resume sooner. Well if I was the SCOTUS I would do it “yesterday” and get the hell out before I got assassinated.

    I am here to say that the new case of Brunson v Adams contains the hottest balance-of-power issue I have ever seen. It is a case by an ordinary citizen. He thinks his right-to-elect was violated by the various frauds going on at the polls in the 2020 election.

    I’m eager to use Brunson’s case to emphasize the citizens’ role against corruption — in all matters, not just voting — but first let me describe the particulars. The docket number is #22-380.

    Raland Brunson first filed a case in the state court of Utah. The feds then asked that it be removed to the federal court because the defendants are federal office holders (President, Vice President, and over 300 of the 535 members of Congress).

    The name “Adams” appears in the title of the case, Brunson v Adams, as Magistrate Alma Adams is the one who allowed the case to be removed to the feds. So, as far as I can tell, Brunson is fighting something called Rule Eleven. That rule is based on a statute which does indeed allow a state case to be yanked out of state hands.

    However, that jurisdictional issue is small peanuts compared to Brunson’s real issue. He complains that one member of Congress (I think it was Sen Ted Cruz) had asked, in December 2020, for a 10-day investigation of claims of voter fraud, but congresspersons voted this down, so it did not happen. (Note: the word ‘congresspersons’ includes senators as well as representatives.)

    Brunson regards that failure to investigate as a crime in itself. He says the Defendants broke their oath to protect the Constitution and the remedy is to remove them from office on grounds of treason.

    Over the years, heaps of citizens have filed in courts, both state and federal, to complain about Congress’s neglect of duty. I certainly have done so, such as in Maxwell v Trump, a case about Congress’s failure to do its duty regarding war. But my cases never make it to the US Supreme Court….

    • If I was the Magistrate I would defer sentencing (as I recall a 558 bond) on the condition that each defendant produce a 2 page essay on the Grand Solar Minimum and also a 2 page essay on the effect of CO2 at different ppm on plant growth. Not a difficult project, but they would have to do some actual scientific research.
