Congress is not allowed to pass laws that fall outside of its grants of power. These grants are listed in plain English in Article I, section 8 of the US Constitution. There is no power for Congress to get involved in law enforcement — that was one of the powers that was reserved to the states. And who shall enforce this balance-of-powers issue?

Why, me, of course.

And how shall I do that?  By my usual method of weaving the 26 letters of the alphabet into words and those words into sentences and paragraphs, and then maybe into articles and books.

That be my portion. I have no other talents.  As Elizabeth Ray once said, “I can’t even answer the phone.”

(If you don’t know who Elizabeth Ray is, WaPo said that Ms Ray, a former beaty queen, had been on Congressman Hays’s committee payroll as a secretary. She admitted that her actual job was to provide sex to Hays. “I can’t type, I can’t file, I can’t even answer the phone.”)

Congress passed a bill that is called the Heyer-Jabara Hate Crimes Act. It is codified at 28 USC 30507. It’s unconstitutionality, per the balance of powers, is of interest, but I am going to zoom right into yesterday’s surprise conviction of a man in a Chicago court.

Jussie Smollett

I will contrast the December 9, 2021 conviction of Jussie Smollett for composing a fictitious hate crime, with well-known hate crimes that should be investigated as fictitious.

Jussie Smollett is an actor, age 39,  on the show “Empire.” He reported a physical attack on himself, in Chicago, in January 2019.  He claimed it was motivated by his gayness and by his being African American. Police investigated and concluded that Jussie had set the thing up, in fact had asked two brothers to attack him mildly so he could make the claim.

According to The New York Times, when Jussie was first charged, a judge let the charges be dropped in exchange for his doing community service. But then Judge Sheila O’Brien sent a Motion to have a Special Prosecutor appointed. After this, a Grand Jury indicted Jussie Smollett.

Yesterday, a jury found him guilty of 5 out of the 6 state charges, all of which have to do with lying. He plans to appeal. I do not intend to sleuth any part of the case. I only want to say that this is a historic moment — someone may go to jail (up to three years) for having said that a hate crime took place when it (perhaps) didn’t.

We conspiracy theorists have a whole basket of cases that we think did not happen, or were not motivated by hate, or happened very differently from the “official narrative.”

The No Hate Act

In May 2021, Congress passed the Heyer-Jabara No Hate Act. Per the FBI’s definition a hate crime is: “A criminal offense against a person or property motivated in whole or in part by an offender’s bias against a race, religion, disability, sexual orientation, ethnicity, gender, or gender identity. “

As we can tell from the name of the act, it reflects two famous cases. Heather Heyer was killed in August 12, 2017 during an attack by a car driver on people opposing white supremacy. (Specifically, the group met on the street, in Charlottesville, to show their opposition to a planned rally by Whites concerning a proposed removal of the statue of Confederate General Robert E Lee. It has now in fact been removed and the bronze will be melted down.

The Jabara name in the title of the law Heyer-Jabara No Hate Act is for Khalid Jabara who was shot dead on his front porch in Tulsa Oklahoma. The alleged motive was religious/ethnic. Khlid’s family said:

This suspect had a history of bigotry against our family. He repeatedly attacked our ethnicity and perceived religion, making racist comments. He often called us “dirty Arabs,” “filthy Lebanese,” “Aye-rabs,” and “Mooslems”—a fact highlighted by the Tulsa Police Department who also heard these comments from the suspect. The suspect’s bigotry was not isolated to us alone. He made xenophobic comments about many in our community — “filthy Mexican” and the “n” word were all part of his hateful approach to anyone from a different background.

On September 7, 2018, Stanley Majors, age 63, was convicted of killing Jabara. One of Majors’ attorneys, Justin Smith, said after the verdict that the defense would appeal. 

The Pulse Nightclub Shooting in Orlando

We will now leave the case of Jabara, completely, and as for the Heyer case, I will elaborate on it below. At this point I wish to bring in the Pulse Nightclub affair. In the wee hours of Jun 11, 2016, Omar Mateen killed 49 people and wounded 53 at the Pulse Nightclub in Orlando, Florida. Eventually, around 6am, police shot him dead.

Hence there was never a trial for Mateen or a chance to determine his motive.  The Pulse Nightclub is for gay men and lesbians. The night of the event was Latino night with about half the guests being Puerto Rican.  There was much talk that the motive of the massacre was homophobic or racist, but that is not how the police wrote it up.

The Pulse Nightclub shooting has gone down in the books as revenge by a Middle Eastern person (Mateen is Afghani-American) who condemned what the US does to Muslims. There was a segment of a few hours in which the gunman at Pulse, Omar Mateen, held some people hostage, asking negotiators to have the US to stop its bombing of the Middle East.

This Orlando event in 2016 predates the No Hate Act, so I don’t think it is recorded as a hate crime.  Note: The 2021 legislation that I mentioned is not one that criminalizes hate crimes. It has only to do with federally funding the states to record hate-crime activity, to help victims get compensation, and to urge better preparedness.

Heather Heyer’s Death at Charlottesville

The current status of the case of the man– James Fields — who ran his car into the protestors at Charlottesville in 2017, is that he was convicted of the murder of Heather Heyer, age 32, and of other charges for injuring several others.  At a December 2017 hearing, 35 people claimed to have been hit during the car’s attack.

James Fields appealed his conviction but it was affirmed on November 16, 2021.  He may still bring it to the Virginia Supreme Court. I hope he does a I believe there is much falsehood involved in the Charlottesville affair.

Recap and ADL Statistics

Let’s recap the four cases mentioned so far. 1. Jussie Smollett of Chicago, who alleged an attack for racism or homophobia, has been convicted of lying; his story was made up.  2. Stanley Majors of Tulsa Oklahoma was convicted of the killing of his Lebanese neighbor, Khalid Jabara, on racial grounds. Omar Mateen was the gunman at Pule Nightclub in Orlando with a death count of 49, but no court looked at it because police killed him at the site.

Besides the classification of some crimes as hate-motivated, there is a category called “extremist-related.” The following was reported by the Anti-Defamation League in 2019:

  • In 2019, domestic extremists killed at least 42 people in the United States in 17 separate incidents.
  • The 42 total deaths in 2019 is less than 2018’s total (53) but higher than 2017’s (41).
  • As is typically the case, the extremist-related murders of 2019 were overwhelmingly (90%) linked to right-wing extremists.
  • Extremist-related killings in 2019 were dominated by the white supremacist shooting spree at a Walmart in El Paso, Texas, in August, which left 22 people dead and 24 more wounded. This attack [was] intended to target Hispanic people.
  • For the eighth year in a row, domestic extremists overwhelmingly used firearms to commit mass killings. Almost half of the people killed by extremists in the past 10 years were killed in mass murders, all but one of which involved the use of firearms.

I note that, in the past, the word “extremist ” has been applied to persons who attack abortion clinics and lately it is being applied to “anti-vaxxers.”

  11. The somewhat obvious issue encapsulated by the term “Hate Crime” is the transgression of traditional state-mandated boundaries. Once upon a time government intervention was limited to physical assault & verbal abuse; there was no cap on personal feelings or convictions. By putting ethnicity & gender in the same bag as religion & gender-identity certain self-appointed entities have demonstrated that they are hell-bent on commandeering our souls

  13. There’s a handful of flights from interstates arriving daily at Sydney airport, international flights are touching down every five minutes, from 4am to midnight, everyday for months now. That’s 72,000 people per day, close to half million every week! If half are new arrivals that’s 250,000 every week. Locals aren’t travelling, so who is?

        A good friend has been kind in offering some hard work, building second floor addition in Marrickville. Neighbouring roof tiles shaking as big carriers fly overhead, they are definetly not local. I think Virgin are doing 2 flights to Perth daily, don’t know about Qantas.

    • Even at 4 landings per hour, at 80 per day or 560 flights per week, if planes are at half capacity, that’s 84,000 people arriving every week.

        • The answer to the question is because they wanted to control the oilfields, which was the main motivation for ww1 & ww2. Israel functions a bit like how Singapore and HongKong did. Muslims should focus on denying they were responsible for 9-11.     On November 30, H.R. 550, a federal bill passed in the U.S. House of Representatives.

    The bill, “Immunization Infrastructure Modernization Act of 2021,” would expand state and local health department vaccine-tracking systems to monitor the vaccination status of American citizens. States would provide the information to the federal government.

    The bill may be difficult to stop as it already has bipartisan support. It passed the House with the support of 294 U.S. Representatives, including all Democrats and 80 Republicans.

    H.R. 550 is now under consideration by the U.S. Senate where, if passed, it could be implemented in under 12 months.

    H.R. 550 would lead to a monumental invasion of our rights as American citizens. It would set an incredibly dangerous precedent and could lead to more vaccine mandates, and more restrictions of services and healthcare for the unvaccinated.

    The bill also creates a mechanism for federal, state and local governments to enforce vaccine passports and possibly no-fly lists. And it would be costly to taxpayers — it appropriates $400 million dollars to expand vaccine tracking.

    Part of this money would be spent on grants and cooperative agreements to state or local governmental entities that agree to adopt the new data collection guidelines set by the Centers for Disease Control and Prevention.

    It’s imperative that we work to educate our Senators on why this legislation poses an unprecedented threat to freedom and liberty, and how it will lead to an unconstitutional invasion of privacy and loss of medical freedom.

    Once freedoms are lost, they’re nearly impossible and extremely costly to regain through legal action. The time to act on this is now!
