I have published several articles having to do with two topics: the stolen 2020 election, and the January 6 invasion of the Capitol. Until now, I’ve been saying that President Trump would not have incited an invasion, as that would cause him to lose the opportunity for Congress to reject some Electoral ballots, constitutionally and legally, at its January 6 joint session — per 3 USC 15.

Recently I made two videos about “Jan 6.”  They are on my website: ConstitutionAndTruth.com. The first one (in which I am wearing a red dress) shows me reading a letter I wrote to the grand jury of Fulton County, Georgia. I wanted to point out to them the unlikelihood of Trump having incited violence.  I now believe I was mistaken.

Today, July 26, 2022, I saw the new video presented by the House Select Committee’s Rep Adam Kitzinger, which includes Trump’s messages to his alleged supporters. It sounds like the president wanted the Proud Boys to do something, though exactly what, we don’t know.

In my second video (wearing a black jersey), I moan about the lying that has become a staple in our culture. The present article has four parts: 1. Trump’s culpability, 2. the stolen election, 3. the right to protest, and 4. our pernicious two-party system.

Let me say here that I am happy to be a member of the Republican Party; indeed I’m a candidate for Congress on the ballot of the New Hampshire primary of September 13, 2022. That fact is quite separate from the analysis I shall now attempt.

Part One: Trump’s Culpability — Correcting My Errors

We are so used to media spin, media suppression of important information, and opacity of our elected leaders, that I assumed the accusations of Trump inciting a group to invade the Capitol were inaccurate. Also, I underestimated the long stretch of time over which the invasion took place. Per the Committee’s video, it lasted more than three hours from the break-in till the goodbye. That’s a lot of time in which President Trump (who was still at the helm) could have exerted moral authority.

I’m a stickler for correct allocation of authority. The US Constitution makes Congress the boss of the “district” known as Washington, DC.  Per Article I, sec 8, Clause 17: “The Congress shall have Power to exercise exclusive Legislation in all Cases whatsoever, over such District.”

Thus, I think (but would need to check) that Speaker of the House Nancy Pelosi and Senate majority leader Chuck Schumer, had responsibility for the Capitol police, and the building itself.  So, around July 11, 2022, when Rep Liz Cheney said Trump committed “dereliction of duty” by not enforcing law during the invasion, I figured it was not specifically his duty.  But now that I’ve heard that Trump incited people, I see a different duty that he incurred. Namely, a duty to call off his dogs.

Off and on, I have seen bits of a speech Trump made on Jan 6 (he is wearing a black overcoat), which didn’t include words of incitement. But today, in the Committee video, I learned of his tweets, and saw more of Trumps’ overcoat speech in which he said: “All Vice President Pence has to do is send it back to the states to recertify.” Then he added “And you’ll never take back our country with weakness. You have to be strong.”

Apparently, Trump wanted Pence to reject bad ballots. But clearly, the law does not give Mike Pence a way to do that. Didn’t anybody tell Trump what’s in federal law at 3 USC 15? It says the Vice President can hear challenges from the floor, on January 6. And then the two chambers of Congress get a chance to debate and vote on each challenge. In my (red dress) video of July 14, 2022, I said that the arrival of invaders, just as a challenge was being raised against Arizona’s ballots, caused the whole procedure of 3 USC 15 to be abandoned. That occurred around 1:30pm. The legislators adjourned — understandably! — till 8pm.

Whom to blame for the abandonment of challenges?  Why, Congress, of course.  I always blame the party in whom the particular responsibility is constitutionally invested. When its members resumed their joint session at 8pm on Jan 6, they accepted all the electors’ ballots.

This means that, constitutionally, Joe Biden would become US president two weeks later, on January 20, 2021, even if some states had cheated.  Congress blew its chance to examine what the states had done. If this happened because the legislators were exhausted and traumatized, well, too bad.

It’s Greek to me why President Trump did not intervene to stop the violence, by way of tweets — even when his son, at 2:35pm advised him to. (Rep Kitzinger displayed Donald Jr’s text to Mark Meadows: “He’s got to condemn this shit, Asap. The capitol police tweet is not enough.” Meadows’ reply: “I’m pushing it hard. I agree.”)

Note: the whole Committee thing is merely an investigation, with hearsay galore. It’s not a trial in which an accused gets to defend himself.  Still, Trump has by now had 18 months in which to make his case to the nation, or to us Repubs. As far as I know, he has never done so. He continues to complain about the stolen election, which is perfectly OK, but that’s a completely separate issue, right?

Part Two: The Stolen Election

Now for Part Two. Do elections get stolen?  Do dogs bark? Is grass green? Yes, dogs bark, grass is green, and elections get stolen. The US has helped steal many a foreign election — think Chile 1973 or Iran 1953, not to mention our indulgence in regime change. But can it happen at home?

Yes, of course.  In 2004, when John Kerry ran against Bush, the amount of cheating in Ohio was beyond scandal. To cite just one example, Ohio registered over 4,000 votes for Bush, in the precinct of Gahanna, where fewer than 700 people voted. Ohio’s Secretary of State J Kenneth Blackwell defied all citizen efforts to sort out the troubles. (See Brennan Justice Centre Report on this, and a book of “Essential Documents” edited by Bob Fitrakis in 2005.)

It’s well accepted that John F Kennedy’s father did a deal with Mayor Daley of Chicago that resulted in a win for JFK over Nixon in 1960. The Electoral College system has the ability to make one state be the key, in that case, Illinois.   It’s also widely said that the 2000 election of George Bush, over Al Gore, was stolen by the US Supreme Court.  That court ordered Florida to stop its vote count, preventing a possible win for Gore.

There is also the fact that hacking and other tricks of software provide such a huge temptation, that it’s hard to imagine all interested parties would abstain. Sidney Powell has got the goods on this.

You must read the book VoteScam, published in 1992 by Jim and Ken Collier. Talks about patriotic whistleblowers! They worked hard at uncovering the way vote figures could be misreported by a consortium of the press known as News Election Service, in the 1980s and earlier.

For the 2020 election, most people simply assert “stolen” or “not stolen.” But unless we get at the facts, from the various states, we are helpless to judge.  The movie “2000 Mules” looks reasonable to me, as does Mike Lindell’s two-hour documentary. The fact that the Jan 6 Committee declines to put these on the table is a bad mark for that committee, is it not?

Could we not expect Congress to have a look at stolen elections? In 2005, the House Judiciary Committee made all sorts of recommendations, but these fell by the wayside. In my opinion, we are, as a society, derelict in our duty. Thus, the woman who died in the Capitol invasion paid the price for our damned laziness.

Part Three: The Right To Protest

As explained in the Declaration of Independence, the founding of our country in 1776 was a protest against bad governance by King George III. And as everyone knows, the Bill of Rights’ First Amendment proclaims the right of the people “peaceably to assemble and to petition the government for a redress of grievances.” Among the groups that rallied in Washington, on January 6, 2021, was a health-related organization run by Ty Bollinger and his wife Charlene. It’s safe to say that they brought their people to the Capitol out of earnest patriotism. Everything about the Bollingers’ behavior over the last several years has been law-abiding and family-friendly.

The law does not say “Feel free to enter and destroy the Capitol.” But there are well-established laws of self-defense and revolution. The Declaration of independence specifically says there comes a time when peaceable protests just don’t work and it’s up to you to push further.  In the state constitution of New Hampshire, Bill of Rights Article 10 tells us:

“Government being instituted … not for the private interest … of any one man, family, or class of men; therefore, whenever the ends of government are perverted, and public liberty manifestly endangered, the people may, and of right ought to reform the old, or establish a new government. The doctrine of nonresistance against arbitrary power, and oppression, is absurd, slavish, and destructive of the good and happiness of mankind.”

That’s where I stand.  I worry that the Select Committee’s entire work of art, regarding January 6, will have the effect — probably intended — of teaching Americans that they must be good boys and girls and not make a fuss against government.  Eeks!

Note: I speculate that the Jan 6 activities of Proud Boys and Oath Keepers were guided by agents provocateurs on behalf of someone who wanted this whole shock to occur. I think it has the hallmarks of a psy-op. Nevertheless, when a government is intransigent, angry citizens ultimately have to take action.

Personally, I have mucho faith in the law and I more or less adore the Constitution. So I try to use creative ways to make law prevail — but, frankly, it usually comes to naught. For example, I filed a proper lawsuit asking for a restraining order against mandatory vax, on Fourth Amendment grounds. Predictably, both the US District Court and the First Circuit Court dismissed it without even asking the Defendant to reply.

What if, the next day I was forcibly injected and got myocarditis?  Would I say “I did not take the matter far enough, violence would have been justifiable”? Alexandr Solzhenitsyn, tortured for years in the Soviet gulag, wrote: “We didn’t love freedom enough. And even more – we had no awareness of the real situation …. We purely and simply deserved everything that happened afterward.”

Bottom line: 2022 is not the year to teach Americans that timidity is a virtue.

Part Four — The Elephant and The Donkey in the Room

I am sick of the way the two-party system degrades us all.  When I lived in Australia, I joined the Conservative Party (whose name is “Liberal”). The opposite, the leftist group, is called Labor. I can recall meetings of the Libs at which the main conversation, for the whole hour, was about the foolishness or malice, or whatever, of Labor. As if our excellence, in the Liberal Party, consisted of not being like “Them.”

Now back home, in US, I find an urge to be a good Republican by being a critic of the Dems. At the moment, this suits me because the Dems are looking like the servants of the Big Globalists and I consider globalism the enemy.  Yet, to consider every man, woman, and child in the Donkey Set to be stupid, or malicious, is not logical. People on either side can be good, and can be bad, or even extremely bad.

The enmity atmosphere has the effect of truly blocking the intellectual development of the Party’s platform. I constantly sense my need to not upset the applecart. If I get elected to Congress, I will start The Middle Aisle Club — a social forum for ideas in which we try to speak each other’s language, just for the hell of it.

I recommend we act mature and think each issue through on its merits. If the Other Party has ideas worth listening to, we should listen. Of course, that includes the Green Party and other small parties.

Most importantly, we have to work at overcoming our natural trait of ingroup/outgroup behavior.   I bet the real enemy, the globalists, are having a ball with our penchant for doing the Donkey/Elephant thing.  For them, it’s a free ticket to Divide and Rule. And by the way we should be using our ingroup/outgroup behavioral instinct on them!

For me, one good has come of the Jan 6 committee, a substantial good — I realized the connection between loyalty and lying.  Joining a Party helps you gain friends immediately, with the basis of the friendship being some degree of shared political beliefs. So you’re certainly not going to say anything to your new friends that is critical of the Party’s moral stature. Naturally, you’ll see the Opposite Party lying, and you will call them Liars.

But then, if your Party leader lies, you must pretend that it’s not a lie. Of course the members of the Opposite Party will then see you, as a Liar (correctly). It will add to the hostility between the groups. Then everybody will be lying on a regular basis and it will become impossible for there to be a forthright discussion about deceit and its costs. I have set for myself the goal of doing something about this, in the immediate future.

        Today we see the new Philippines govenment led by Marcos is dealing with an earthquake and the response is to form some sort of department.             Another aspect to the great Trump debate is nothing to do with policy but instead concerns social conservatism vs. social progressiveness.
            People who were already hardened in their views, roughly aged about 30 in 1970, might have remained socially conservative, others got on board with “The Sexual Revolution” and “Turn on Tune in Drop Out” and became social progressives. Of course we understand now sex & drugs was probably a CIA program but it appealed to the young baby-boomers who were full of hormones. It also appealed to all sorts of perverts including in the church which later fell apart under the influence of the Sexual Revolution, leading to doctors becoming the new priesthood. All strategised to a large extent by people experienced in “statecraft”. All that aside Trump in his youth may have been more permissive than people a little older than him and the times, “swinging 60’s” and onwards were more permissive than anything before. So Trump is being concemned by some principally for being a creature of his time. Where is the actual dirt ??? If there was any we would have heard about it, endlessly. So the judgment of some appears to be IMPAIRED by this. We all look at the past, when we were aged about 25 or 30, through rose-coloured glasses, “those days were the best”. In fact they weren’t so different to other days, just that we were aged about 25-30.
            ( Some exclusions would apply, for example if you were sent to Vietnam to shoot people for the MIC ).

It seems this is why the M$M is hounding Trump, lining up their bleeding hearts and trying to get people to cry as they always do nowadays. Talking heads are out, blubbering heads are in. So this is really a battle of golf courses, where of course all the serious deals are done.   6. 1) We have video of Trump warning his audience that things might get violent and urging them to go home.
    2) Adam Kinzinger is one of the biggest liars/crooks in Congress. I wouldn’t doubt that he has edited video to make Trump look guilty. I’ve watched Donald Trump for 45 yrs – because he was always warning Americans about what the crooks in govt were about to do or had done to harm America/Americans. Ever since his candidacy for the presidency, I’ve followed everything he said as well as everything the mainstream media has said to make him look bad. He was never a racist, had a black girlfriend who came out and told us about it, has been going to poor black neighborhoods to see what he could do to help and has always had America’s best interests at heart. There are so many lies told about him, there isn’t space to enumerate them here. He is NOT a rabble rouser who would incite violence anywhere.
    I am APPALLED as an American that Mary Maxwell could be so easily taken in by the deep state – it says to me that she has not done her research very well and cannot distinguish truth from lies. I’ve spent 25 yrs researching the deep state, every single day for hours on end I’ve devoted to researching and I have a pretty good idea of how the deep state operates. Ms. Maxwell, you do not have my support nor my respect. I think you need to re-examine this case because basically you are siding with Nancy Pelosi, one of the biggest criminals to ever hold a govt position. She is a known pedophile, a constant liar, a child trafficker and she has not ounce of morality. She is the one propagating all these lies. I lived in her district and followed her, and this is the person you are siding with???

    There were two prompts for me to produce today’s article. One is in Part Four, where I throw off the shackles of UNREASONING Party loyalty. In future I’ll say more about my proposed Middle Aisle Club, which is not dependent on my winning a seat in Congress.

    The other prompt was Adam Kitzinger’s presentation. It made me regret my letter to Fulton Co [red dress video], in which I said that I believe Trump did not encourage the invasion. I now see that he did encourage it, per his words from Washington Monument (black overcoat).

    And worse, if he wanted citizens to assure a decertification by Mike Pence, he didn’t give them any instructions as to how to do that. “Be strong” is not OK — it could make a person think they should “use all means necessary.”

    Then he compounded the injury by failing to say “Nya-ah” when violence broke out. Dee, you and I both saw the cops open doors for people, but later some of the invaders were using crowbars against police.

    But now get a load of this: My article today used Rep Kitzinger’s research to proclaim that Naughty Trump did not tell the invaders, early enough, to go home. But a minute ago I looked up BBC’s article and it shows the president telling people at 4:17pm to go home.     Dee, your final question is “Who orchestrated this false flag?” That’s what a House committee should be finding out, and/or what a DoJ should be indicting people for. It’s the sort of thing GumshoeNews.com has been attending to for years.

      • Yes these are mitigating factors, however they are involved in a worldwide conspiracy that is hurting us, mind, body and attempting soul now.
        I would prefer that the rope was just to cordon them off, but they do not play by rules that we will ever find acceptable. I wish I could just stamp them with DEBUNKED.
        At some point, some of us are going to be forced on the tools, and I think this “process/thing” going on now is needed for the correct weight and calibration(historically direction as well). This is a two way street

          • If you accept that some of these “leaders” are just puppets and are not in themselves the planner. It follows that this(the following actions) are not as bad.
            I never gave a hall pass to them though, and if they run the gauntlet, well, I’m not intervening.

Stil my timeframe for all these events is somewhere beyond 2060 so anything could happen, and maybe all this will turn out to be a dress rehearsal. The great Tiwanaku Empire of South America flourished for six centuries with no need for, or evidence of, a ruling hierarchy with weapons, soldiers, and armies of conquest. Though they had no written language we know they flourished in what is now Bolivia, Peru, and Chile between 300 AD and 1000 AD, with some suggesting that their culture may have extended many thousands of years deeper into the past. Their power came not from swords or clubs but from a highly desirable civilization with a religion based upon Sun worship. Agricultural and social skills were key to Tiwanaku power, as well as their knowledge of how to brew alcohol from maize, and make psychedelic drugs from local plants. These were generously administered at the great festivals that were integral to Tiwanaku life. People did not need force to encourage them into such a union.

    The Tiwanaku enjoyed trade and commerce, religion, art, sculpture, ceramics, textiles, irrigation, fashion and a highly integrated and cooperative social structure. In short, they maintained an equitable sustainable civilization for longer than did the Roman Empire, and organized it from the bottom up without the need of kings and military structures. We are community animals by nature, blessed with high intelligence. Living together should not be a difficult task but a joy. When Tiwanaku civilization eventually collapsed it came about not by conquest but by climate change, after decades of prolonged drought.

  14. This comment is 8 months after the article. I offer a correction to my claim that the 3 USC 15 procedure got halted by the Invasion. It got only a temporary halt. After reconvening that night, Congress did follow the rules of procedure for certification. But when they voted that night on dumping some of the swing states electoral ballots, they did not have a majority for dumping.
