There is a CBS video, dated June 8, 2020, in which the US Secretary of Defense Mark Esper criticizes the decision made by President Trump to “call out the troops” against protestors. You may expect me to be all in cahoots with Esper on that one.

Surprise. I am not in cahoots. That’s because I don’t think the mayhem is being caused by “protestors,” and because it is constitutional for a president to deal with “insurrections.”

I do, however, approve of Esper shooting his mouth off.  I can’t recall another moment when a cabinet member stated his disagreement with the president – except when Atty Gen Jeff Sessions insisted on recusing himself from the Russian probe in 2017.

Of course, we all know that Gen McArthur disagreed with President Truman (and got bounced for it) – but then a general is not a cabinet member.

The idea of party loyalty is being enforced all out of proportion these days. The US is a republic. All citizens should be pitching in, and certainly all cabineteers, and all Congresspersons, to give what they can give from their own “lights.”  So, thank you, Secretary Esper.

It is my guess that the Big Takeover is a-happenin’ and the so-called race riots are being provoked in order to set the stage. It may feel as though violence, of itself, is the issue. Yet I look ever to law as the source of People Power and want folks to know which principles they can bravely stand up for.

This article will first review the constitutionality of martial law, and then sketch the relevant legislation such as the Insurrection Act of 1807 and the Dick Act of 1903, both still in force. Note the criminality of participating in an insurrection:

“Whoever incites, sets on foot, assists, or engages in any rebellion or insurrection against the authority of the United States or the laws thereof, or gives aid or comfort thereto, shall be fined under this title or imprisoned not more than ten years, or both; and shall be incapable of holding any office under the United States.”  — 18 USC 2338

Article II Powers To Use Force Domestically

Now what about the president’s prerogative – or duty—to call out the troops to deal with, say, rioting?   Article II, Section 3 of the Constitution says

“he shall take care that the laws be faithfully executed.”

Wow. That’s quite a responsibility in any century but in the 21st it’s pretty overwhelming. There is also Article II, Section 2, with specific mention of the militia:

“The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States.”

The phrase “of the Militia of the several states” (50 of them) means, in today’s institutional set-up, the National Guard.

The phrase “when called into actual Service of the United States” could mean two things. The fact that it is attached to the preceding phrase “Commander in Chief of the Army and Navy”? could mean that the president becomes the Commander in Chief of the various National Guard forces when they are performing overseas along with the regular military.  It can also mean that the president is Commander in Chief of them during a call up for domestic action.

Clause 15 and 16 of Article I, Section 8

And where is his authority to call them up? He has to get that authority from Congress. The famous Section 8, within Article I, has 18 clauses, each naming a power of Congress. Thus we see:

Clause 15. “The Congress shall have Power … To provide for calling forth the Militia to execute the Laws of the Union, suppress Insurrections and repel Invasions.”

Clause 16. “The Congress shall have Power … To provide for organizing, arming, and disciplining, the Militia, and for governing such Part of them as may be employed in the Service of the United States, reserving to the States respectively, the Appointment of the Officers, and the Authority of training the Militia according to the discipline prescribed by Congress.”

A president’s power to call up the troops even for an overseas war is dependent on Congress having “asked” him to do so. Article I, Section 8, Clause 11 says “Congress shall have Power to declare War. Since 1952 presidents have not “asked” and Congress has hardly made a fuss, but that’s beside the point here.

How about the States’ Article – Article IV?

In the Constitution’s fourth article, we find only one reference to a warlike situation. – Article IV, Section 4:

“The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the [state’s] Legislature, or of the [state] Executive (when the Legislature cannot be convened) against domestic Violence.”

That is known in the trade as “the Guarantee clause.” I find that utterly fascinating, and beautiful. It must have taken some imagining of the future for the Framers to come up with it.

At the moment, 223 years after it was written, I can’t picture a scenario in which a governor would call upon the feds to act against “domestic violence” but it can’t be ruled out. The governor of California did so in 1992 over the riots that followed the Rodney King affair. (I believe, but cannot prove, that that affair was scripted.)

The Second and Fourth Amendments

Only one other part of the Constitution fits into our search for items that could help us evaluate (legally) what Trump has called for, namely the Bill of Rights. This package of ten amendments to the Constitution came into force in 1791. Its Second Amendment says:

“A well-regulated militia being necessary to the security of a free state, the right of the People to keep and bear Arms shall not be infringed.” (The term “well-regulated” in those days meant “working properly,” not “tightly bossed”).

The Fourth Amendment says:

“The Right of the People to be secure in their Persons, Houses, Papers and Effects against unreasonable Searches and Seizures shall not be violated, and no Warrants shall issue but upon probable Cause, supported by Oath or Affirmation….” [Emphasis added]

The Dick Act

In 1902, Congressman Charles Dick of Ohio introduced a bill for a Militia Act “to supersede the archaic Militia Laws of 1792.”  A booklet was circulated, in which we can read the words of members of an “Interstate National Guard Association” making favorable comments on the new plan.

Most likely they did not see the consequences of their willingness to have us go from an entity that was “Interstate” and consisted only of an “association” — to a centralized entity, the National Guard.

It was not Charles Dick but Elihu Root who was behind the “reforms.” I am guessing that he had an eye to World War I, which did not begin until 1914. We can briefly look at the changes that have taken place in regard to militias, and then analyze their constitutionality.

Today in the United States there are approximately a million soldiers, of which half are regular army, another 200,000 are Reserve forces (people who hold another job but can be called up if needed), and almost 300,000 “National Guard.” Being in the Guard is a full-time job, and most of one’s time is spent in the home state.

In 1902 there were not yet any Reserves, as such, or National Guard, as such. The first army had been brought into being before we had a US Constitution. (After declaring independence from Britain, in 1776, Americans had “Articles of Confederation” for 12 years. The Constitution got ratified on June 21, 1788.)

From 1788 to 1902 the US had made war on Britain, in the War of 1812, on Mexico in the Mexican War of 1849, on local Indian tribes, and on Spain in the Spanish-American war of 1898. The troops consisted of a standing army plus the states sending some of their militia-men to help out.

The Dick Act, also called “The Efficiency in Militia Act of 1903” created a National Guard. You will want to know who is the Guard’s boss. Refer back to the powers laid out in Articles I and II of the Constitution. The states, through their governors or legislatures, control a state militia, but when Congress “feels like it,” it can call those state militias into national service.

(Note: I oppose the nationalization of the Guard for reasons apart from the issues discussed in this article. In a nutshell, I think a federal militia is too far away from the community. We need local militias, in the form of posse comitatus.)

State Militia

I think that the Dick Act’s trick of calling the Guard the National Guard, has caused Americans to lose sight of the way “militia” was construed by the Framers.

A militia in 1787 was whatever the state constitution of each state said it was. Roughly, it was a Posse Comitatus. Typically, a band of citizens age 16 to middle age who would obey the governor if something urgent came up.

In regard to the 2013 Boston Marathon bombing, which was a false-flag operation, I advised Governor Charlie Baker to use his powers to defeat an invasion by the FBI. I quoted Article VII from Chapter II of the original Massachusetts Constitution of 1780. Per an amendment, its current wording is:

“Article VII. The general court [that’s the name of Massachusetts legislature] shall provide by law for the recruitment, equipment, organization, training and discipline of the military and naval forces. The governor shall be the commander-in-chief thereof, and shall have power to assemble the whole or any part of them for training, instruction or parade, and to employ them for the suppression of rebellion, the repelling of invasion, and the enforcement of the laws. He may, as authorized by the general court, prescribe from time to time the organization of the military and naval forces and make regulations for their government.” [Emphasis added]

Can You Have a Private Militia?

Recall the Second Amendment of the US Constitution: “A well-regulated militia being necessary to the security of a free state, the right of the People to keep and bear Arms shall not be infringed.” Although that is construed by most people to mean “you can’t take my gun away,” it also means that citizens are responsible for the defense of their free state.

Can this militia be something other than the National Guard? In my opinion, the second amendment permits private militias, in the sense of community militias.  Citizens can even use their Second Amendment militia power against the elected authority of a state or federal government if “necessary for the security of a free state.

Note: there is federal legislation that forbids private militias to parade around with guns or to wear military-type uniforms. It is at 10 USC 771.

Is President Trump’s Proposal Legal?

As already stated, the Constitution allows a president to call out the National Guard to meet a crisis. To do so he would have to get Congress’ permission, as we have seen. But Congress cannot permit it for just any old reason:

Article I, Section 8, Clause 15. “The Congress shall have Power … To provide for calling forth the Militia to execute the Laws of the Union, suppress Insurrections and repel Invasions.”  [Emphasis added]

As early as 1792, Congress passed legislation that hands the “calling forth” power to the president with certain restrictions. This was the first of the Insurrection Acts, although only the 1807 legislation had the name Insurrection Act.

In respect of the citizen’s right to assemble, the 1792 Calling Forth Act required that, before troops would try to disperse a crowd, a proclamation must be made by loud speaker, warning the people to go home peacefully. That is still in force, at 10 USC 254:

“Whenever the President considers it necessary to use the militia or the armed forces under this chapter, he shall, by proclamation, immediately order the insurgents to disperse and retire peaceably to their abodes within a limited time.”

In 1861, in order to use troops for the Civil War, President Lincoln asked Congress to allow this to happen short of an invitation from any state governor.

Two famous uses of federal troops to assist with civil rights were Eisenhower’s action in 1954 to enforce school desegregation in Kansas, and in 1965 by LBJ for the Selma to Montgomery marches, at which the use of dogs, televised, made a unique impression on the populace.

The current activity has included violence against looters, such as the use of rubber bullets and pepper spray. This was done by state police rather than troops. It has led to a flurry of legislative interest in such things as revoking immunity for police and the keeping of an interstate list of troublesome cops. Speaker of the House Nancy Pelosi has mentioned “defunding the police,” but it is not clear what this entails.

In short, President Donald J Trump, whose 74th birthday is this week, is — so far — obeying the Constitution.

    • When I left the States I thought I had left all that ‘black’ victimization culture behind, now I still get it on the news and on the ‘net.

      I’ve had lots of black friends and roommates, but the vast American black culture is one of racism against other races, primarily whites and Asians. I’ve never been robbed by a white, but I have by blacks. I’ve had plenty of blacks talk racist crap to me.

      The black Africans I have known were not racists, they were just people. The American blacks used to tell them they “didn’t know how to be black” (what an insult).

      The ‘Affirmative Action’ of giving blacks preference for jobs, positions in schools and other racist policies based on skin color has done little to help a culture seeped in negativity (just listen to rap lyrics).

      I just read on another site that the Bureau of Justice Statistics from 2018 that there were 593,598 interracial victimization reports. Of those, black against white was 537,204 – approximately 90%. The white against black was 56,394 – less than 10%. (I never even reported being robbed, no sense in doing it)

      Throw in the figure from 2018 that only 13.4% of America is black and one can see the disproportional criminal propensity of black Americans. Thus, one should begin to appreciate why American police approach a black person with more caution.

      I’m glad I’m out of the States, I don’t know what the solution is, but ‘taking a knee’ is not one of them.

      • Terry – speaking of cops – a uniform has the tendency to bring out the very worst in some folk. Officer safety training is paramount when dealing with those individuals/groups that when confronted for whatever reason, the bad vibes received from them puts one immediately on alert.

        It was my experience to note that those who wished to do harm against the thin blue line were mostly imports and indigenous, rarely did I ever get physical threats from Whites.

        ‘Profiling’ has become a dirty world of late, but I can vouch for the effectiveness of such awareness in protecting my own safety.

        Your graph should be a mandatory lesson for those ‘victims’ looking for a cause. Word is that 40% of Black America now supports Trump, and if true, then that only leaves 60% of Black America who still see themselves a victims.

        It’s a pity your comment did not venture into how Democrat controlled areas of the United States are the real problem areas of the country, and there are ample stats available to support that assertion. Seems, that the 60% of the Black population are still beholden to what the Democrats tell them

        • Thanks Nemesis, I choose to take the “thin blue line” as a calling(nurse style, only special people can handle and others please don’t apply) as peace makers.
          The uniform that always had the “hat” of king(bobby ref), but big men would make the best peace makers if thinking in a small group context(the group{that the peace makers used to belong}calling the shots at this “traction point”). Having the jug head requiring a 10 gallon hat(humour) is ok.
          The uniform gets a hip extension, well that causes the other to profile, not wrong just what happens when the ante is lifted. Extrapolate to the “standard” uniform in Oz little alone Merk being now the problem. Really a amour vest is now needed “standard” to chase paper details of an instant occurring hours before(I believe so).
          Thin blue line always welcome in my fox-hole, the hat could double as a ear muff.

        What you say was supported by the young Americans on my safaris, who said that African Americans then rioting targeted Korean shops, furious that by working hard these very recent immigrants had become employed and prosperous whilst blacks still lived in poverty.

        While lack of motivation and initiative is the immediate reason for black US poverty, the demographic of 40% in poverty is essential to the American economic model (which is probably higher than 50% right now). Moreover, once a person is unemployed for 6 months, he or she is removed from the statistics as unemployable. In Australia the fudging is achieved by classing 1 week of work, study, or training as employment; and as the unemployed must study employment prospect enhancement, they are then classed as employed. Likewise, if they are Aboriginal and on CDP, they are ’employed’. Thus, 10% unemployment hides 60% unemployment.

        Techniques at lying to the people aside, victimism is actively promoted by educationists, propagandists, academics, and social scientists. For example, the high proportion of Aborigines in prisons, and otherwise lacking in education and skills, is primarily because there is no parenting whatsoever. Children are not told what is considered right or wrong, or what is socially-acceptable behavior, or that bashing people is a crime. Aspirations, other than to be a great AFL player, do not exist. Children are told by their parents that aspirationalism and education is white-feller bullshit and that bad things that happen to them are a direct result of “white invasion”.

        Pre-contact Aboriginal ‘parenting’ was in fact the role of four classes of grandparents and discipline was the role of uncles, an excellent practice which has decayed to almost oblivion. Only in the NT does this tradition survive but even then, within around 15% of families. It has not occurred to actual parents that they must take up the slack and non-Aborigines who observe this do not understand the genesis of this behavior.

        Victimism and tokenism is promoted and funded by powerful interests. For example, the utterly absurd Treaty/Constitutional Recognition cause is paid for by Riotinto, BHP, and the Liberal Party, none of which have the interests of indigenous at heart.

        Tragically, both African Americans and Australia’s urban indigenous are easily manipulated to destroy themselves. Police also, do themselves no favours.

The anger of blacks can be appreciated in looting and damage to property being a sign too establishment and others their frustration being treated as subhumans by predominately whites and drawing attention to the murder of a innocent black, property cannot be more valued than loss of innocent life, after the initial fury response that became a protest throughout the world of a more salient and acceptable form and endorsement by the wider community, the contribution the black community economically is significant, for white individuals to chastise the blacks for stepping out of line is worthy of further consideration with regard to a assumed superiority that after two world wars of so called civilized white nations is some what idiosyncratic, it seems now a sign of the white community is slowly waking up, my problem with victimization is that after we obliterate all those who are considered sub species eventually I would become part of the next cleansing, who is white having several centuries of white breeding in the West of Britain, it is thanks to the blacks, m

    • Hi Ned – I’ll have a try. One point at a time.

      There is Q (drops) and then there are all those Q analysts/commentators (Q-anons I believe they are called).

      The ‘drops’ are really quite cryptic and to the layman would be quite difficult to interpret – in fact it could become a full-time obsession/distraction.

      Yet almost as soon as these ‘drops’ appear, so many Q-anons seem to have navigated this deliberately complex maze and have the explanation down pat – almost as if they have been given a ‘study guide’/’teacher’s notes’.

      I am quite sure that a number of Q-anons are genuinely trying to make sense of things (Dustin Nemos appeals to me) while others are clearly ‘whackos’ or just out for publicity and hence profit (?‘Blessed To Teach’).

      One article I watched or read just recently talked about how people (psychologically) needed to ‘belong’ to a group – thus many flock to Q in genuine good faith and in hope.

      • Julius and Fair Dinkum – ‘Q’ is first and foremost a military intelligence operation, and as such, issues directives via the ‘Q’ board to those forces who are in place to stealthily take down the Globalist/Deep State, piece by piece, when called upon.

        There is no personal recognition in any of the ‘Q’ operation, apart from ‘Q+”, and that aspect should be looked at as keeping the emotional aspect associated with being a member of a club completely out of it.

        And one can only ‘get into’ ‘Q’ if one can expand their thinking into exploring possibilities that they have probably never ever thought of.

    From what I can gather the “mayhem” in question is common theft and vandalism. Unless there’s been a direct attack on some federal institution or other I can’t see how the National Guard could possibly have any legal jurisdiction

    Berry, I would be against the use of troops against protestors.

    From what I saw on YouTube videos (which was like a quick survey, of cars burning and general mayhem) I did not take it to be a protest, as in First Amendment type thing.

    At that point — without investigating the reality on the ground, as that is not my job — I launched into a query about the constitutionality of a prezzie calling out troops domestically. As you may know, I often catch the US govt red-handed doing something unconstitutional, but after searching the USC, I had to let Trump come up clean on this one.

    Again, I spend a lotta time defending states’ rights, but per the US Constitution Trump can go into an insurrection situation irrespective of whether someone is attacking a state thing or a federal thing.

    • An insurrection is an overt attempt to supplant a government. Getting one’s jollies from arson, robbing a quickie-mart, or just a faux sense of morality doesn’t fit any such bill.

      I’d say that, bar the Covid 19 shutdown, nothing on such a scale would have taken place. An awful lot of people are just bored shitless. Dispatching the National Guard won’t do anything but impute undue political credit.

      • interesting that such folk invariably gravitate to where they’re highly visible, as opposed to setting themselves up in the bush where they’d have a much better quality of existence; minus the victim kudos of course.

        • I have to agree with that Berry. I’ve been on the streets and I would have preferred to have a shelter out in the bush, away from problems and with plenty of firewood to cook and keep warm. Which in places like Washington or Oregon would be easy enough to find.

          From my experiences in shelters, the people all have their stories, but they tend to gravitate to others that also have the same mindset. They live on the fringes of society in order to still survive, parasitic is a word that comes to mind.

          When I was hitch-hiking across the States to Europe, I stayed in a broken down building in New York that charged me $1.25 a night for a bunk ($1.00 to sleep on a mattress on the floor, but the rats would walk over you). I was working packing boxes during the Christmas rush at Macy’s (the only ‘white boy’ on the team). I used to pick up a load of ‘off cuts’ of cheese, salami, meat, bread from the Deli when I left (I got a discount as I worked there). I’d eat my dinner on the subway back to the shelter and then when I got there invite any one else that was hungry to join in for a communal meal. There was never anything left at the end. I have a few stories about that place and many others, but you get the idea.

          I found that the people I ran into ‘chose’ that lifestyle.

          • Terry your story of the homeless rings true with me. What is never reported on concerning the ‘homeless’ is that most of them, and from my own experience in dealing with them as a law and order issue, are there by choice, and not by circumstance as governments and vested interests like to promote.

            While the lying media refuse to do their job, the public will remain gullible to whatever government and vested interests tell them.

            maybe you should try experiencing homelessness from the point of view of actually not having a home, and not from the point of view of having to “deal with them”.

            Most homeless people ARE NOT THERE BY CHOICE!!!!
            a lot of them are there because of mental health issues… and others.. because by the grace of god, a single misfortune sent them there and they are left with YOU to DEAL WITH THEM!

            That implies that not ALL of them were there by choice, there are many examples of that, but that unfortunate predicament was not being discussed – you have made it so to suit your own bias against anything I write that you like to attack.

            That was my experience, you weren’t there, so how can you make a judgement on what I have experienced?

            Being homeless is a lifestyle choice for most of those considered as homeless – so go rent a violin and play to someone else who cares!

    living on the side of a mountain for 3 months…
    back in the 80s
    I could get by…

    if i tried the same thing today, Id be arrested.
    I have no idea about the states or Europe..
    however.. I remember being kicked out of the Salvos because as i wanted to get down down from bed one morning.. i said to the bloke sitting on the bunk below me..

    ” look out mate, im coming down, I dont want to jump on you!”

    when i turned up in the evening i was told i was no longer welcome because i threatened to jump on the person below me….

    i challenge anyone here .. and ill go with them! – to see if its easier to live in the bush for 3 months or easier in a city….

    of course there are people who exploit the system… but that doesnt mean there are not an outrageous number of genuine homeless .. desperate people..
    through no fault of their own, and despite their best efforts.. are going to sleep tonight… cold… hungry.. and without a roof over their head…

    many men, women, kids.. in australia… the fkn lucky country ffs

      On a more serious note – we all have to survive somehow, Some make it without much effort being put in, while others have to work really hard at keeping their heads above water. And then there are those who just give up, throw in the towel, and find life on the streets much easier to deal with.

      Circumstances for those who choose that lifestyle are as varied as is the life in this world.

      But, everyone has a choice in this world as to their circumstance, the mistakes that one makes in his/her life tend to form the circumstances of the lifestyle they then find themselves in.

      • The subject really needs it’s own page, however I would say that as“home” is an abstract concept(one that real estate sharks seem to love), the term “homeless” shouldn’t be confused with the housing crisis.

        • That being said, mortgage slaves are also widely portrayed as victims, which, strange as it may seem, also accommodates the very System to which they are tied. In both cases there’s a co-dependency that can only be annulled by the one who’s taken on the loser role.

  9. How many people here bought houses before the zillions of extra taxes that have crept in over say, the last 30 years or more?
    Or before more and more onerous loan qualifications were required by law, translating into higher interest rates on the life of your loan?
    Or before the massive influx of migrants that have since rolled in, inflating prices according to the law of supply and demand, when the generation of baby boomers selling their houses would have seen something of a glut in the housing market which would have had a depressing effect on prices, keeping them within the reach of more australians?
    The amount of money the banks have earned from this is just unimaginable.
    And it all flows directly out of Australia, never to be used in our economy again.

    No wonder the young have no respect for boomers. And therein lies your challenge. And you have no answer. (there is one)
