The House Should Appoint Rep Thomas Massie As Speaker Immediately

Each of the two houses of Congress has power to do certain things on its own. Per the US Constitution’s Article I, section 2: “The House of Representatives shall chuse their Speaker.”

That is, choosing a speaker does not need the approval of anyone, other than majority of the House’s own 435 members. Rep Mike Johnson was chosen in 2025, and he could be replaced at any time by a vote of the House. I recommend that the House vote as soon as possible to replace Johnson with Rep Thomas Massie.

My reason for suggesting this has to do with the fact that President Trump might be impeached soon and that JD Vance who is Vice President would become president and but he, too, might swiftly be impeached.  If both Trump and Vance are removed from office simultaneously, the order of succession lists the Speaker of the House as next in line for the presidency.

Removal of Johnson as Speaker

There is no method for impeaching any member of Congress.  Article I, section 5, says that each House, “with the concurrence of two-thirds of its members,” may “punish its members for disorderly behavior” (such as by censure), and may “expel a member.” I am not recommending any disciplinary action whatsoever against Rep Mike Johnson. The focus here is on getting Massie as Speaker in view of the fact that the Speaker might become president if Trump and Vance leave office. Massie is particularly strong.

Note: Possibly there is a House Rule today specifying that the Speaker, once chosen, is entitled to a specified period of time in office. I don’t think there is such a rule but if there is, it would not prevent what I am recommending, since Article I, section 5 holds that “Each House may determine the Rules of its Proceedings.”  If a House makes a rule it can also change it.

Possible Impeachment of Trump

Another of the House’s “We can do it ourselves” provisions is at Article I, section 2: “The House of Representatives … shall have the sole power of Impeachment.”  If the House  does impeach a president, it then sends its Articles of Impeachment to the Senate where a conviction may, or may not, take place.

In 1868, the House voted to impeach President Andrew Johnson, but he was acquitted by the Senate. In 1967, President Nixon avoided a threatened impeachment by resigning from office. In 1998, the House did impeach President Clinton on the grounds of perjury, obstruction of justice, and abuse of office. But he was saved from conviction by one vote in the Senate.

In 2019, President Trump was impeached for abuse of power and obstruction of Congress, but the Senate voted to acquit him. Again, in 2021, during the final week of his presidency, Trump was impeached for his alleged Jan 6 “incitement of insurrection.” The Senate received that Article after Biden was already inaugurated.  On February 9th, 57 senators voted ‘guilty’ — less than the required 2/3 majority. Note: conviction by Senate is not a legal decision, it is political, has very little due process, and no avenue for appeal.

Recent Attempts To Impeach Trump

In 2025, during Trump’s current presidency, Rep Shiri Thanebar introduced seven articles of impeachment against him, including for “usurpation of the appropriations power,” “creation of an unlawful office” [DOGE], and “bribery and corruption.” This did not make it to a committee vote (and has not been mentioned by the media!)

In December 2025, Rep Al Green introduced Articles against Trump “for taking our military to war against Venezuela.” Of course a president has the right and duty to deal with foreign policy, but definitely not to initiate war. That is reserved to Congress under Article I, sec 8, Clause 11: “The Congress shall have Power … to declare war.”

In 1973, following war-making in Vietnam by two presidents (Lyndon Johnson and Richard Nixon), Congress decided to enact a statute to lay out more specifically what a president may do, such as to undertake emergency military action. This is the War Powers Act.

It would never allow a president to start a war such as Trump did in February 27, 2026 by attacking Iran (for making nuclear weapons). It is the duty of Congress, both Houses, to decide on such a major move.

Possible Impeachment of Vice President Vance

Article II, section 4, says: “The President, Vice President, and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.” The word ‘misdemeanors’ implies a political power of Congress to remove a president for next to nothing.

I recommend that the House impeach Vice President JD Vance, before it undertakes to impeach President Trump. If Trump leaves office now, whether by conviction, resignation, death, or incapacity (per Amendment XXV), the vice president would properly move into the White House.  This can be avoided by impeaching Vance.

No US vice president has ever been impeached. During Nixon’s presidency (1969-1973), Vice President Spiro Agnew was coerced into resignation. He had apparently done some crime when he was Governor of Maryland. In his 1980 book “Go Quietly…or else,” Agnew said that he was threatened with other means of disposal if he did not leave voluntarily. In his book Agnew also reports that General Haig ran Nixon’s presidency from the basement of the White House.

The 25th Amendment to the Constitution, ratified in 1967, says: “Whenever there is a vacancy in the office of the Vice President, the President shall nominate a Vice President who shall take office upon confirmation by a majority of both houses of Congress.”

Note: That amendment has informally been called ‘The Rockefeller Amendment’ as it had the effect of getting Nelson Rockefeller into the vice-presidency. First, Nixon resigned in 1973. The presidency would then have automatically gone to Agnew but Agnew had already resigned and been replaced by Vice President Gerald Ford.

When Nixon resigned, Ford became president. Ford then had the chance to appoint a vice president. He chose Nelson Rockefeller who had been governor of New York from 1959 to 1973.  If Ford himself died in office, Rocky would have become president. Indeed in 1975 there was an attempted assassination on Ford by Squeaky Fromme, a member of the Mason Family, but it did not succeed.

Summary

I hope that Rep Thomas Massie, who believes in strict adherence to the Constitution, will make it to the presidency. The next chance for him to get the job directly is in the 2028 election. However, as the US has just started a war unconstitutionally. President Trump may be impeached and convicted for, say, usurpation of Congress’s war-making authority. (It is unlikely that Congress would have voted to attack Iran.)

I also think Vance is impeachable, but I have not listed any reasons for that here.

I have tried to show that if we end up elevating a speaker to the presidency, we need to think now about what person should be holding the office of Speaker, as he/she is first in line in the order of succession. (That order is not in the Constitution. It came about by a statute, The Presidential Succession Act of 1947.)

I have not mentioned that Massie is Republican or that Thanebar and Green are Democrat — when we’re in a world war, all members of government should leave their Party at the door.  I also did not mention that I am a Republican, as how could it matter? I have a deeply Republican devotion to “the parchment,” but I’m sure many Democrat citizens are parchmentarian, too.

Note: Back in2025 when Mike Johnson won the speakership, the House had a Republican majority. Democrats were asked to cross the aisle for him but only two did so. Many more would presumably cross over for Massie as he has a more bipartisan view of things.
