by Mary W Maxwell, LLB

I have just received an email from “NRSC” asking me to buy a red tee shirt marked ‘I support President Trump.” The email says:

“Millions of Americans supported President Trump in 2016. Now, Schumer, Pelosi and the Democrats are trying to ERASE conservative Americans’ votes. Make no mistake, this rushed impeachment is an attack on President Trump, our country, and YOU.”

I disagree that the Democrats will erase conservative votes. They could just as likely increase conservatism. I also disagree that the impeachment “attacks” the country, or me. Trump should be saying “Bring it on! I want to clear my name!”

Republicans have faith in the Constitution. They’d know, from the Federalist Papers (written by James Madison and Alexander Hamilton in the 1780s) that impeachment was the Framers’ way of dealing with a president who just did not jive with the Constitution’s understanding as to his/her powers.

Conservative voters want to do the right thing. Rule of Law is never negotiable. Period.

Please Resign Now, Mr Trump

I am here to ask for the man’s resignation. He should go a.s.a.p., so we can get the nation back on course. Trump has lowered the tone of American culture to such an extent that bullying has become the norm. And fancy saying Muslims can’t enter the country, even if they already have a green card. Yes, he did say that.

During the first week of Trump’s trial, the Senate votes were about procedure, such as the calling of witnesses. The tallies were repetitive: 53-47, 53-47, etc. What a disgrace.  The United States does not have a Westminster system in which a party’s leader instructs a bunch of elected leaders. Why elect 100 of them and pay them $174k each per annum if only one does the work?

In 2017,  I was willing to support Trump. He was new in office, and it had been rumored that he was going to Lock Her Up.  Many of us in Australia (where I lived from 1980 until recently) are well-versed on the subject of Pizzagate, and hope Mrs Clinton will be charged, indicted, tried, and punished. This needs to happen in order to put the brakes on child trafficking. (See my books: Deliverance, and Reunion.)

Republicans Can Still Get a Grip

The nation’s republicans are hereby called upon to stop waiting to “learn” what’s happening in the US Senate, by watching it on the news.  We need to make the news: “Trump’s party demands that he step down for the sake of republicanism.”

In Australia I was a member of the liberal Party (that’s the conservative party; the opposite is Labor). We members spoke of “the parliamentary wing” of the party, as something separate from the Party. The parliamentary guys are the ones who got elected. They answer only to their bosses in Canberra — or maybe “higher than Canberra.”

Never did I see our local parliamentarians answering to the broader Liberal Party — the members. You may expect that at our monthly meetings, we’d spend our time cooking up the things we wanted to have federal parliament legislate on. Heck, no. Each meeting had a guest speaker — an Honorable — who would bring us news from the legislative front.

On the Hustings

I am currently a presidential candidate for 2020, albeit only in the one state of New Hampshire. I’m as republican as you can get, mainly small-r republican but also officially Republican. My campaign is what you might call “unfinanced” — I did not even bother to put a Donate button on my website, www.ConstitutionAndTruth.com. But I enjoy going around to party meetings in New Hampshire. (I live in the state capital, Concord.)

Last week, I went to a 96-member meeting in the White Mountains that was so good I was jaw-dropped. Boy, did I come away a happy camper. Conservatism is not yet dead. The chairman invited me to speak for two minutes. I said something like this:

“You may think I’m old because I was born in 1947. But in fact I was born in 1787. I have never got past the Philadelphia Convention.  I am married to every word in the Constitution and also the words behind it, such a “separation of powers” and “checks and balances.”

That was warmly received. But there was a tacit understanding in the room that “we all love Trump.” I didn’t make the Resignation demand that I am expressing in this article, as I didn’t think of it.  Also, I know that even my contesting Trump for 2021 is offensive to some.  The South Carolina’s Republican Party did not even permit folks to register as presidential candidates this year.

That is nuts.  Our president could keel over and die tomorrow — couldn’t we all? And he could get ousted by impeachment. (They say a vote to use secret ballots would result in impeachment, isn’t that interesting?)  But if so, the South Carolina ballot will be sporting a Democrat candidate, unopposed.  I am sorry that the people of that state did not loudly protest.

At the aforementioned Republican meeting,  I received a few much-needed hugs. Some of the huggers whispered  “Be brave” or similar encouragement.  I’m now considering that this may have been a code for “Divorcing Donald is not off the table.”

Any Precedent?

I want Trump to go, as an acknowledgement of the Constitution. He says it’s all a witch hunt.  That could well be so. But even if Schiff et al are being harmful to the Constitution, don’t worry, they can get their punishment. Truth will out. We cannot, however, have a president shouting that he is not subjectable to investigation.

In 2017 I sued President Trump, to get an injunction against his threatening to “nuke” North Korea. His threat was dangerous and irresponsible. Perhaps he was only being theatrical, but it’s not OK to be theatrical in such circumstances. This violated Article I, section 8, clause 11 of the Constitution — which means Mr Trump has no respect for the balance of powers. He boasts that no balance is needed!  Fathom it.

It is said that the Supreme Court held President Harry Truman back from making an unauthorized war-move, but the case had to do only with his threat to seize the steel mills.  (Youngstown v Sawyer). That was easy for the court to rule on — not that we should worry about what is easy for the court. The steel mill ruling wasn’t really a balance of powers decision.

In regard to President James Polk authorizing a Mexican war without Congress’s permission, a less-than-impeachment remedy was found —- Congress censured the president.

As for modern precedent, Richard Nixon resigned rather than face impeachment (and likely criminal charges).  That was 1974, before Internet, and before a large section of the population was clued in. Personally I wasn’t clued in at all. Only decades later did I discover, partly from Spiro Agnew’s book, Go Quietly … Or Else,  that the entire coup d’etat was orchestrated.

If there is any orchestrating to be done today, it should be by us, not by the media, not by the two sides having a dog fight, not by the parliamentary wing, and not by sub-rational loyalty. We Republicans are the dopes who failed to catch Trump when he violated the Constitution day in and day out.  We need to shape up.

And while Trump did us a favor calling Senator Elizabeth Warren out for lying about her ancestry, he is now exposed for lying about his ancestry. He claimed his Dad was born in Germany, but the actual birthplace was Manhattan.  How can it be that neither Warren nor Trump shows any shame when caught out? Honestly, People, we can’t survive in a world of lies. It is changing everyone’s “reality testing.”

The 25th Amendment

Now for the particulars of Amendment XXV of the Constitution which was ratified in 1964. The death of FDR in 1944 saw Vice President Truman rising to the presidency; Truman did not appoint any new VP as there was no constitutional provision for that. The 1963 assassination of JFK brought Lyndon Johnson to the presidency. He presided, for the remainder of Kennedy’s term until January 1965, without a VP.

In 1967 Amendment XXV of the Constitution was ratified. Its section 2 says:

“Whenever there is a vacancy in the office of the Vice President, the President shall nominate a Vice President who shall take office upon confirmation by a majority vote of both Houses of Congress.”

In 1973, Vice President Agnew (1918-1996) resigned under pressure. The 25th Amendment was invoked, and Nixon gave himself a new Vice President, Gerald Ford (1913-2006).

In 1974, President Richard Nixon (1913-1994) resigned from office. Thus, Ford automatically. became President. This gave Ford the chance to appoint a Vice President. He chose Nelson Rockefeller (1908-1979).  It is rumored that Nelson had all of this in mind when he helped lay the groundwork for the 25th Amendment, back in the 1940s.

Whom Could President Pence Appoint as Vice President?

If today’s Vice President, Mike Pence, gains the presidency before January 2021, that is, before Trump’s term runs out, there is a huge pool of persons from which he could choose a Vice President. Think about it.

The man, or woman, must have the qualifications of a president: be a “natural born” American, be at least age 35, and have resided in the US for 14 years. Plus, that nominee must not have already been a US president for eight years — so Bill Clinton, George W Bush, and Barack Obama are excluded from eligibility.

Of course, Congress would get to restrain Pence’s imagination, as a majority of both Houses must confirm the appointment. The nominee may be Republican, but does not have to be.

I suggest that we start a search now. Such a search may indeed turn up some names that the Electors can consider in the Electoral College, in December 2020, for a new president, to be inaugurated in January 2021 — even if President Donald Trump fills out his term.

To start the conversation, I hereby nominate Senator Rand Paul, MD, age 57, for the job of Vice President if Trump leaves office. Rand is a strict constitutionalist. He talks about reckless federal spending all the time to his constituents, which is about the most unpopular thing you can talk about to your constituents.  Goodonya, Senator!

Rand Paul ran for the Republican nomination for president in 2016, but lost to Trump. His father, Ron Paul, had tried it in 2008, but lost to Senator John McCain.  Rand is able to see though the fakery in foreign policy.  He co-sponsored, with Rep Tulsi Gabbard, a bill called Stop Arming the Terrorists Act.  It failed. How could a bill like that fail?

Time to wake up. So much is at stake.

Note: another senator who’s looking good, is a first-termer, an intellectual from Nebraska, Sen Ben Sase. He is home-schooling his children.  That’s all I’ll say for now.

Finally, my apologies to The Party for not having faith that all will work out. Isn’t it more likely that if we bow to the “parliamentary wing” and do nothing, we will end up with one of the socialists in the White House?  Their campaign promises are Cornucopia city.

Mr Trump, please be a hero.  Please yield your position. History will be kind to you.

You can make America great again, in this most unexpected way!

  1. Rick Wilson of The Daily Beast has responded to the president’s promise to put “heads on pikes” if GOP senators go against him. I quote:

The decision by Senate Majority Leader Mitch McConnell to make the Senate impeachment trial of Donald Trump an exercise in raw power politics is grinding toward its foregone conclusion.

The creation of a new form of American government, where the executive branch is permanently and utterly above the law, oversight, and accountability is upon us, and the exoneration of Trump in the Senate is the moment that historians will look back on and say, “There. Right then. That was the tipping point.”

The weaponization of the departments of Justice, State, and Treasury into formidable arms of the Trump Organization is nearly complete. Bill Barr isn’t an Attorney General; he’s the Enforcer General of the unitary and puissant executive branch.

And it’s all because Republicans in the Senate don’t have the courage God gave the common rat.

Senate Republicans are going to let Trump skate, and permanently realign the balance of power in the process, because they’re too chickenshit to stand up to his tweets, too terrified of a primary by some MAGA nutters, and too dumb to understand they’re ushering in an era that looks like nothing we’ve ever seen in this country.

This is a one-way ticket, a ratchet toward a system that rewards a culture of threats by bullies and thugs like Trump with their desired outcome. It peels back the cowardice and weak-dick posturing of the Senate GOP like little else. They’re willing to ditch it all because they’re scared.

    — end of quote. I guess there was a bit of “language, Ned, language” material, but I let it stay.

  2. Oh Dear Mary, you really have gone off on a trip with the fairies! So why not tell us why you believe Trump should resign – for instance: what has he done that would require him to step down? And I will remind you that the wars previous admins became involved in have ceased, North Korea and Iran are being ‘domesticated’ with a view to expanding their people’s welfare and prosperity while the U.S. middle class and minority employment have never seen it so good since Trump’s election.

Not too mention the economic reset that will occur this year that will see the Central Banks of this Rothschild controlled world collapse and our return to the Gold Standard that will benefit us all. Do you think that Brexit would have actually come about without Trump being elected? Don’t you see what Trump has done with China while getting back the riches that were stolen from America over many decades by China via the one way street ‘level playing field’ treaties put in place by previous treasonous administrations?

Don’t you get if Mary on why Trump tweets? Trump tweets because the MSM constantly attack everything he says or does? So how does a President who is constantly under attack by impeachment/Russia/Ukraine Democrats and their media arm, the MSM, get his message out to the American people? Do you deliberately ignore the tens of thousands of Americans who will queue for hours in all kinds of weather to see and listen to Trump? Please point out in American history where a sitting President has commanded the crowds seen at his rallies? Are all those supporters as stupid as those he constantly battles against? Has it not occurred to you that ALL of the Demonrat contenders for president combined, can not out perform the crowds, the numbers of which exceed anything that America has ever witnessed in the history of America, at the Trump rallies?

Truly, is all that lost on you?

Trump this year will win by a landslide the likes of which the American people have never witnessed before. Mark my words, you denigrate, and willingly by your own words, one of God’s warriors that is putting America to rights from the decades of evil that once controlled it. That you cannot see this says much about your own naivety concerning the ways and works of this world.

Open your eyes Mary, there is so much more to see and to learn!

    • With all due respect, I think that you have already forgotten the July 2019 telephone call between Trump and the president of Ukraine. When the head of a government uses his standing for personal affairs, that is a real danger for that nation and for the world.

Look at the way he treats women – no respect at all. Is that what you want for America, a president that leads by this awful example. Is that what you want the young american men to believe that women are just sexual toys?

Remember the children that died last summer after crossing the Mexican border. What could be more innocent than children? Everyone is looking for a better life and it should not be just a privilege for Americans.

I will not call ‘Trump’ President as he is not one at all. A President is elected by the PEOPLE and for the PEOPLE. A true President that he be Democrat or Republican cannot use his standing for his own personal affairs.

      • Trump has distain for everyone. However he likes young ladies like Miss America, but draws the line at raping 13 year olds like his mate Jeff Epstein.
The people don’t want a President or leader at all, but apparently many are enthralled by the show, giving the appearance of respectability.
Hope the thralls wake from this boring and repeated show, makes Gilligans Island seem fresh and new.
Why must the show go on, I’d rather a no show.

  3. I have discussed my view with Mary — that the swamp is so embedded with criminals, people that participated in 9-11 — death and plunder — all treason. That this impeachment is a distraction from the real criminality.

I believe the system was “lost and sold” decades ago. Is the President not obliged to consider corruption of another nation when handing over tax payer dollars, anyway?

I’m hoping the swamp (deep state) is being drained. Pleeeease T get on with it.

  4. “Trump this year will win by a landslide the likes of which the American people have never witnessed before”. No he won’t, Nemesis. That’s my point. The Repubs could find themselves in November with an unwinnable nominee.

Did this not happen to the Repubs of Alabama in 2017? They loyally marched shoulder-to-shoulder with Judge Roy Moore even after he had been accused of whatever. Since 75% of the voters in AL are Repub you’d think the Dems did not stand a chance. Yet their man, Doug Jones, won the election. Hillary could win the White House this November.

So I am saying: Get a winnable Repub now. Anyone who wants to put a name forward, drop me a line. MaxwellMaryLLB@gmail dot com. With 300 million Americans, there are tens of thousands of citizens who could qualify.

  5. For the record. I did at first compose this article a few days ago to show the “advantage to Republicans” of getting a new candidate. It was not meant to be a dirge for our society.

But now, after the Dershowitz statement in Parliament (you know what I mean), I am dirging all over the place. Do people not see the significance of letting the government get away with outright eschewing of the Rule of Law?

This is John Yoo’s wet dream of presidential “plenary” power. Have you seen the Gendamerie in Paris attacking the Yellow Vests? Have you seen the Brits tossing Julian Assange into solitary? That’s how it is, once Rule of Law has made its exit.

  6. Business as usual for the Democratic-Republicans. Steal, expand and rotate. Put on a top hat if you need, but never discuss the hidden hand.

  7. Not taking sides here, for very good reason, but… James Madison was the person who rewrote the Constitution by excising every phrase created by the original author, Thomas Paine; phrases like “All authority resides in the people” (which is the opposite of RULE OF LAW) and “the people shall decide all aspects of taxes, most of which are to protect and support the poor, the aged and the infirm”… and so on. I once interviewed the descendants of Thomas Paine and they actually believe he wrote the Constitution. They are sadly unaware that the (failed) Bill of Rights was a belated attempt to restore Paine’s inspiration. The powers who commissioned Madison to emasculate the Constitution rewarded him with the Presidency. This is the same elite that controls American politics, including blackmailing Trump to do 180 degree policy flips in Israel. As to the impeachment, it is intended as a diversion from America’s $4.8 billion bloody coup of Kiev and of Joe Biden’s blatant corruption there. In the end, as long as Americans are de-educated, dumbed-down and disenfranchised, America has no sustainable future. Its middle class has been shrinking, its poverty class is now the biggest demographic, and private armies are soon to be inflicted on those who protest (thus bypassing Constitutional protection). For all his megalomania, narcissist personality disorder, and palpable ignorance of all things geopolitical, he is still the most likely politician to avoid WWIII. Pence, Biden, Lindsay, et al, are psychopaths and sociopaths… very literally.

    • “For all his megalomania, … ignorance of all things geopolitical, he is still the most likely politician to avoid WWIII.”

I disagree, Tony. I don’t think any identifiable politician can control the “outbreak” of WWIII.

As for Pence, if he becomes prez, and war breaks out, I don’t think it will have anything to do with a prez — and certainly not Congress.

By the way AUMF came up for renewal again today. I will let you know who won. As if we couldn’t predict.
