After the Frankfurt Affair – Concepts of Liberty, Legitimacy, the Authority of Envisioners, and Government Criminality

My December 6, 2020 article at GumshoeNews.com was entitled “After the Frankfurt Affair:  Plan A – Happiness.”  It showed the good things that could come of Gina Haspel’s alleged arrest. And I promised a “Plan B – Hell,” a list of horrible things that may happen instead. But “B” will now have to wait as there is an urgency about explaining how the law depends on certain concepts such as liberty and legitimate authorty.

I was appalled to receive a Newsletter today from the Government Accountability Project, GPA. That’s a group that supposedly helps whistle blowers. Their newsletter contained a lengthy December 1, 2020  quote from – wait for it – CNN.  Here’s a bit of it:

“Washington (CNN) An attorney for the Trump campaign on Monday issued a call for violence against Chris Krebs, a former cybersecurity official who was unceremoniously ousted from his post by President Donald Trump after he rejected the President’s unfounded claims of widespread voter fraud.

“Joe diGenova, the attorney for Trump’s campaign, “Anybody who thinks the election went well, like that idiot Krebs who used to be the head of cybersecurity. That guy is a class A moron. He should be drawn and quartered. Taken out at dawn and shot’.”

The GPA is pointing to Joe diGenova as the harm doer and Chris Krebs as a whistleblower. I don’t get it. Krebs got fired for saying the election has no issues. A Trump man then called him an idiot.  Granted, he also said they guy needs to be boiled, skewered, or something like that.

But we routinely say things like that, don’t we?   “I’d like to break his bloody neck” type thing. I don’t see Krebs as a whistle blower even if he suffered the loss of his job. So he proclaimed the voting honest — bully for him. Each person can form an opinion. All presidential appointees can get the sack when a president doesn’t want them anymore.

As for the other guy – who made “violence-inciting remarks” – CNN wants to cast him as dangerous.  Let CNN say that, who cares, but when the GPA – a helper of whistle blowers — says it, we need to worry! It could mean that any criticism you express might soon be cast as incitement.

By the way, I am a great one for saying treason should be prosecuted, and during our colonial days the punishment did in fact include the British penalty of “drawing and quartering.” Frankly I’m OK with just using a lethal injection or a hanging.

I’m also OK with granting amnesties – conditionally – since a huge number of people are about to get outed as traitors. There just won’t be enough nooses. There wouldn’t even be a sufficiency of morticians.

Who Is the Enemy, the Government or the People?

Let me remind fellow Americans what our government is about. If you are young and think the government is there to help you, you need to be educated.  SOCIETY, not government, is the helper. Government is a necessary evil, so to speak. We should look upon the government as our enemy.

Says who? Says the men who established our nation. In 1787 they sat down and framed a Constitution that provides all sorts of ways to keep a lid on government’s power. It is UNDERSTOOD that folks who start to fill high office will lose self-restraint. You would, too. I would, too.

The ability to control millions of people is intoxicating. So it’s foolish to say “Yeah, but we hope they will be nice and not do that.” Instead, the Framers built on the ego, jealousy, and greed of our rulers by inserting mechanisms that would cause them to discipline one another.

Three examples: a snake-in-the-grass judge can be kicked out of office via impeachment by the legislature. Isn’t that nice?  A federal office holder who is too big for his britches can be opposed by the 50 state governors yelling for their “states’ rights.” A beloved president who can sway people to the point of becoming kinglike can be limited to two White House terms.

That last one wasn’t in the 1787 Constitution.  It was added by Amendment after Franklin Delano Roosevelt, in 1944, managed to be elected to a fourth term. See? People didn’t just say “We’ll let any man try his best, maybe he’ll get 6 terms.” No. They knew our emotional proclivity for loving and worshipping a leader is not a good thing. So we must place a check against it. Ding! Amendment XXII.

We Are the Boss

Long story short: the American government is there to serve particular needs. It’s up to everyone to control it and not be controlled by it. We own it. We employ the officers to serve us. Every one of their prerogatives has well-thought-out limits.

Oops.  I forgot to note that today there is another powerful enemy – big business.  Such as the near-monopoly of Big Pharma. Big Oil. Big Media.  Big Google. Big Agribusiness. Big armaments. Do we have a constitution against them? No but we have laws, such as the Sherman Anti-Trust Act that makes it a crime for a business to get too big.

Fact is, though that BIGNESS means ability to buy off, or scare off, or kill off anyone who plans to use law against them. The US population is 328 million. Presumably, that’s “bigger” than even the biggest guys in a monopoly boardroom. But sadly we don’t use our strength.

Why? Our culture – largely designed these days by Media – lulls us into forgetting our strength. I am here to remind you of your strength. Hence, Plan C will lay out the laws that can help you get on top of the situation.

Think of the William Tell legend.  The king commanded that Tell bring his young son to a designated place, put an apple on the kid’s head, and shoot an arrow into the apple.  William tell successfully shot the arow into the apple.   But in case he missed, he had another arrow in his quiver to shoot at the king.

An American should not let his/her rulers try that sort of thing in the first place.  Any such outlandish demand by a president should be met with punishment.  Let me assure you that there is ALWAYS, in our law, the means to preempt such behavior by officials.

But you have to be willing to use that law. Law does not pop off the page and work by itself.  It takes citizens and it takes a culture of expectation that the citizens will partcipate – eagerly, indignantly, lustily.

It also takes respect for truth. If you think everyone must routinely lie to get the best position for himself, you won’t get anywhere. Law can’t work in a culture of lying.

The Concept of Liberty

Recall what was said, above, about the guy (Joe) who wished somebody (Chris) would be killed. Joe thinks Chris is bad because he denies the facts about vote-cheating.  What could Joe do, besides yelling “death to Chris”? Probably there is nothing he can do about Chris, within the law.

Some human actions simply aren’t governed – we are free to live, to love, to worship, to eat junk food, and to call people names. “Moron” “dickhead,” whatever. Indeed, it has been mapped out in the Bill of Rights that some areas must not be controlled by government.

I guess you could say that since that’s the case, there is no need for an American to know what the law is in those areas.  Wrong! You need to know how to guard against incursions into your liberties. It takes a lot of work because there are persons and entities wanting to demolish that precious possession of yours – liberty.

Unfortunately, also, there are many of your peers who want to hand in their liberty, as they prefer dependence, submissiveness, and God knows what. So you have to struggle against that realty, too.  Still it can be fun if you have a crowd working with you.   It can be exhilarating.

As I said, Chris Krebs is free, as an individual, to state his opinion that the election was fair. He can say that there is no such force as gravity, if he wishes.  But what about Joe diGenova who expressed anger? Can he say what he wants about Chris such as that Chris is a moron? Yes.  Good old First Amendment free speech.

But the business of saying something that could incite a third party to kill Chris may be a problem. If you deliberately make an effort to incite a murder, you can be charged with a crime.  What crime? I have just typed “incitement to crime” into my browser and Google spat out several links. I chose this one from mtsu.edu (Middle Tennessee State University):

“In applying the clear and present danger test in Schenck v. United States (1919), Justice Oliver Wendell Holmes Jr. observed: “The question in every case is whether the words used are used in such circumstances and are of such a nature as to create a clear and present danger that they will bring about the substantive evils that Congress has a right to prevent.”

If Chris asks police to arrest Joe for inciting the public to murder him, the police will say “Get outta here — there is no clear and present danger.” Perhaps Chris could sue Joe for verbally assaulting him by the epithet “moron,” claiming hurt feelings or something.  I doubt he would win.

So let me repeat that I am genuinely worried about the Government Accountability Project glibly quoting CNN. Why make a mountain out of the Chris /Joe molehill?  Everybody at GPA is legally trained and can see that Joe has not broken the law. Is GPA interested in curbing our liberties? OMG.

And why didn’t CNN (or GPA) say “Hey, has Chris Krebs got such insight that he can know for sure that no vote-cheating occurred, when there are many current complaints before the court?”

The Covid Pandemic and the Concept of Legitimacy

I have written a book entitled Grass Court: How To Use Law To Deal with the Pandemic. In it, I express my belief that the purpose of the pandemic is to stop all our normal activities, rendering the whole world’s economies open to a strong-arm takeover.

That is hardly an original claim by me. Global groups such as the WEF – World Economic Forum — and Agenda 2030 have openly stated for years that the goal is world government.  Of course, that means no more United States government. No more Bill of Rights. Did you agree to give up your nation and your rights?  No. Neither did I. So the plan is foul.

And so now we must look at another concept legitimacy. People attribute legitimacy to something if they approve of it. “Yep, I like that arrangement. A majority of us like it so we will make it stick.” As no American has had a chance to “vote-in” the planned One World Government,” that entity  has no legitimacy.

Would some group be so rotten as to cause a false lockdown, based on an alleged germ in the air, in order to evade the need for a legitimizing vote? Of course. How did Genghis Kahn get to be Genghis Kahn? He just did as he pleased, and had the might to make his wishes materialize.

The Concept of the Authority of the Envisioners

Today’s WEF has a lot of might. Many of its personnel have worked for the MF – International Monetary Fund which has had seven decades of experience in forcing its will on nations. The IMF started by making loans to Third World countries but now has a grip on many “advanced” nations. They openly dictate policy, be it for the nation’s road building, hospitals, sex education, or whatever.

All of this directs our attention to another concept: the “authority” of the envisioners. Just read the pamphlets put out by the WEF or the Rockefeller Foundation and you will see that their leaders hold some vision as to how the world should work. Does that make them authorities, with the right to push everyone around n pursuit of utopia?

Granted, their vision may be only a cover story. But it is something on which you can approach them.  “Hey, let’s inspect your vision of our future. How is it that you guys, out of 8 billion humans, have been so brilliant as to arrive at what’s best for all?”

Note: looking past the words is essential to any intellectual operation. Quite likely if IMF people are engaged in intrigue, their goal is not “the happiness of the human race.” It is the happiness of a few – who may have gone down a wrong path even as far as their own welfare is concerned!

Criminality in Government

So far we have discussed the concepts of liberty, legitimacy, and the envisioners’ authority. Now let’s move to criminality in government. This is the area in which I mainly work. I plainly adore the fact that American law is so clear that wrongdoing can be brought to a halt. If persons are overstepping their rights and hurting you, you have redress.

A distinction can be made between public law – which includes criminal and administrative law — and private law. The latter is not private in the sense of secret. It is private in that the matter is a dispute between private citizens or organizations.

The court can apply the law to settle private disputes. “Your Honor, my next-door-neighbor breeds skunks and the smell is killing me.”  “Skunk breeder, you must desist, based on statute # 45544” or “based on the Jonstown precedent in common law.”

However, in this article, we look only at public law, almost exclusively criminal law, the criminals being, frequently, our servants in government.

Picture an American named Dorothy who is vaguely aware that there is something fishy about the pandemic. She is worried about the forced vaccinations, and she has also heard that we will become a cashless society. Very likely she has no knowledge of the fact that a fishy pandemic, and a removal of her cash, are crimes and that someone can be punished — and that she herself can arrange the indictment (via a citizen-led grand jury).

Dorothy may assume that the attorney general can hold back on using criminal law to catch criminals if he so pleases. Are you kidding?  If he does that, he is committing a crime.  There is a whole section of the law, which I call Blackstonian law, that has to do with misusing the rules either to let a criminal off, or to bear down on someone who is not a criminal.

“But they do it all the time.”  Yes, Dorothy, that is because you are lazy, foolish, unpatriotic, or lacking in survival instinct!

Crimes of Government re Covid, Lockdown, and Vax

There is federal law to deal with the crimes of treason, genocide, and obstruction of justice.  All are felonies and two of them carry the death penalty. I have explained this in detail in my book Grass Court: How to Use Law To Deal with the Pandemic.

The article at hand is entitled “After the Frankfurt Affair: the Concepts of Liberty, Legitimacy, the Authority of Envisioners, and Criminality of Government.” It is part of a series that cogitates on what will follow the reported Frankfurt arrest of the head of the CIA Gina Haspel.

The first item in the series covered “Plan A – Happiness.”  That is, all the good things that may follow from a restoration of honest government. The second item, “Plan B – Hell,” was a dire warning of what is in store if that restoration fails. This third item, about Concepts, is meant to put the events of the day in a wider intellectual context, such as by analyzing liberty.

The fourth and fifth items will cover, respectively, how people can apply the law, and how a president can apply the law. Note: I am not sanguine about the prospects of survival of the American republic,  as the media is not even letting the public know that Haspel was arrested.

  2. The tail wages the dog, the Constitution(taken from the articles of confederation) was about a unified response from a collective of staunch areas from an outside oppressor.
    This is the garden path, no good was even going to come from, what will be endless amendments.
    You can bang on about, free speech, all you like, never matters to the big gun.
    The way forward would be to starve the “fed”. The few resources left, horses, are able to quarter those that still get in the way of the living.
    William Tell, is Gina Hesburg(sic), he had a crossbow that is very accurate. I think the business end is called a bolt, the most likely end if horses could fly. Not seahorses though, both can lie underwater.
    I thought Q was going to drop that Biden was under house arrest because of his “boot”.
    K, because I respect you and all, Law needs to step back. It has become a hobble, let the wild horses run yeah yeah.

    If people express the natural human inclination toward spiritual growth, they free themselves from fear and anxiety, and effectively develop a sort of immunity to the influences of negative entities. If not, our vibration attracts hostile spirits and we fall unconsciously unto their influence.

    “There are beings in the spiritual realms for whom anxiety and fear emanating from human beings offer welcome food. When humans have no anxiety and fear, then these creatures starve… If fear and anxiety radiates from people and they break out in panic, then these creatures find welcome nutrition and they become more and more powerful. These beings are hostile towards humanity.

    Everything that feeds on negative feelings, on anxiety, fear and superstition, despair or doubt, are in reality hostile forces in super sensible worlds, launching cruel attacks on human beings, while they are being fed. Therefore, it is above all necessary to begin with that the person who enters the spiritual world overcomes fear, feelings of helplessness, despair and anxiety.     With such profound global fear, anxiety, and panic over the present pandemic, many are exposing their own spiritual sicknesses and acquiescing to any recommended behavior or intervention that might alleviate these emotions. Along with this is the push to vaccinate 7 billion healthy people.

    Nearly 100 years ago, in a series of 14 essays published under the title, The Fall of the Spirits of Darkness, Steiner issued a warning to future generations about a possible measure of mass control, quite similar to the visions presented by Orwell and Huxley. Steiner foresaw a future when vaccines could steal our spiritual nature.

    First, some background:

    “In these fourteen lectures, given at the end of 1917 following four years of war in Europe, Steiner speaks on the complex spiritual forces behind the World War I, humanity’s attempts to build theoretically perfect social orders, and the many divisions and disruptions that would continue on Earth into our own time. Humanity in general was asleep to the fact that fallen spirits, cast from the spiritual worlds, had become intensely active on Earth. This manifested mainly in human thinking and perception of the surrounding world. ” [Source]

    The fall into such destructive slumber would be marked by an age of materialism and centralization of power, during which the influences of ‘spirits of darkness’ would inspire humans to devise new technologies and new means of oppression. Steiner comments:

    “I have told you that the spirits of darkness are going to inspire their human hosts, in whom they will be dwelling, to find a vaccine that will drive all inclination toward spirituality out of people’s souls when they are still very young, and this will happen in a roundabout way through the living body. Today, bodies are vaccinated against one thing and another; in future, children will be vaccinated with a substance which it will certainly be possible to produce, and this will make them immune, so that they do not develop foolish inclinations connected with spiritual life – ‘foolish’ here, or course, in the eyes of materialists. . . .

    “. . . a way will finally be found to vaccinate bodies so that these bodies will not allow the inclination toward spiritual ideas to develop and all their lives people will believe only in the physical world they perceive with the senses. Out of impulses which the medical profession gained from presumption – oh, I beg your pardon, from the consumption [tuberculosis] they themselves suffered – people are now vaccinated against consumption, and in the same way they will be vaccinated against any inclination toward spirituality. This is merely to give you a particularly striking example of many things which will come in the near and more distant future in this field – the aim being to bring confusion into the impulses which want to stream down to earth after the victory of the [Michaela] spirits of light [in 1879].” ~Rudolf Steiner

    Steiner was talking only about vaccines here. His comment does not consider the compounded effects on human spirituality of the many myriad influences we have in our world today, all of which work against spiritual connection on their own right.

    Again, if you’ve felt at all like you’re in a spiritual war, you’re not alone.

  4. I am of two minda on the 8 year limit. On one hand, i completely agree. But also, if someone clearly is doing some good and the long list of stooges before him are any illustration of what will likely come next, why change for a known greater evil? The real problem is the private clubs we call parties that only have the random factor of a self-financing billionaire with some previously cultivated star power branding to propel him into office begrudgingly.

      Just think what sort of world we’d have today if JFK had never been assassinated.

      He would’ve served two terms at a minimum, at the end of which there would’ve been no Vietnam War (hence no wasted blood and treasure and tremendous prosperity).

      With landslide majorities in both houses for JFK, it would’ve been a formality to repeal the XXII Amendment limiting a POTUS to two terms in office (the public would’ve been demanding it), and JFK would’ve served 3 or perhaps 4 terms.

      At the end of that, brother Bobby would’ve stood for office and served a few terms of his own.

      Not long after that, JFK Jr would’ve been eligible.

      Wall to wall Kennedy’s for most of our adult lives would’ve entailed :
      1) No wars fought on behalf of Israel
      2) An Israel very likely without a nuclear capability (JFK would’ve seen to that – and Boycotted/Sanction/Divested them to kingdom come in the event that they surreptitiously got the bomb ).
      3) No 9/11.
      4) No CIA.

      Ohhhh, what a wonderful world we truly would’ve had.

    • It seemed to me over the decades that 4 year terms just always seemed to be just a bit too short, meaning that the policies any party put into place did not really produce noticeable results within four years. Or, four years were not quite enough to show just how bad a particular party was. So have been of the mind that there should really be 5 year terms, to prevent bad parties getting elected for another 4 year term inflicting needless suffering on our persons.
