Hawaii and the “Guarantee Clause” of the US Constitution

I live in New Hampshire. Have only been to Hawaii a few times, en route to Australia. I can sing one of Queen Liliuokalani’s many songs.  I can pronounce “Aloha.”  When I was a kid, I had a hula hoop (we all did.) The color was a sort of phosphorescent yellow.

Oh, and my brother-in-law in Scotland could play, on ukulele, “I Want To Go Back to My Little Grass Shack in Something or Other, Hawaii.”

That’s about it for my personal connections to the 50th state. But am I ever feeling Hawaiian at the moment!  You know me — it only takes a clause of the US Constitution to send me into a sort of ecstasy.  Behold Article IV, Section 4:

“The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence.” [Emphasis added]

This article will be concerned only with the first part of that sentence. Thus, I’m not talking about domestic violence (such as civil war) in Hawaii — and anyway, there hasn’t been any “Application of the Legislature or of the Executive”.

The two phrases to be discussed are “Guarantee to every State… a Republican Form of Government,” and “protect each of them against Invasion.”

It Was an Invasion

In case anybody missed it, there was an invasion of the state of Hawaii, particularly the island of Maui, especially the city of Lahaina, on August 8, 2023 (aka “8-8”). Go ahead and tell me it wasn’t an invasion, if you like. Tell me it was a weather event or an electrical fire from power lines. You are entitled to interpret the event as you wish, and so am I.

I interpret it as an invasion by a group of persons against the state of Hawaii. For what purpose? I have heard people say “for a land grab”. Or possibly “for child stealing.” My interest today is constitutional and, for this, it doesn’t matter why an invasion took place. It matters only THAT an invasion took place.

For such, I need to indicate that it was not a home-grown attack on Maui by the authority of the State of Hawaii itself.  Granted, I can’t absolutely prove that it was not Hawaiians who did the awful deed. I am making a leap of faith when I say it was outsiders.  Should it eventually be proven that Hawaiians deployed the weapons that caused the fire, I will graciously bow out. In fact, I will recant. But I think it is extremely unlikely that locals arranged for a shocking conflagration.

Oh, and that’s another fussy point.  I have chosen to concentrate on just one place, Lahaina. And just one date, 8-8. Do not worry that I may thus be cheating some people elsewhere on Maui who got hurt.  This is not like a “civil rights” suit, or a claim for compensation. If I could get the United States to recognize that Hawaii was invaded, the beneficiary of the guarantee “of a republican form of government” would be all the citizens of Hawaii.

I hear you say, “But some citizens there may be wanting a different form of government, such as a monarchy.” True. I can’t help them. We haven’t got a clause for that. I shall proceed on the presumption that what Hawaiians want is to live in a republic and that they will be glad that the Guarantee Clause exists to help them in this 2023 crisis.

Directed Energy Weapons

Nikola Tesla (1856-1943) was born in what is now Croatia and came to the US in 1884 at age 28.  This is from Encyclopedia Britannica:

“Tesla was from a family of Serbian origin. His father was an Orthodox priest….Training for an engineering career, Nikola attended the Technical University at Graz, Austria, where he first saw the Gramme dynamo, which operated as a generator and, when reversed, became an electric motor…. Later, at Budapest, he visualized the principle of the rotating magnetic field and developed plans for an induction motor.“In Colorado, where he stayed from May 1899 until early 1900, Tesla made what he regarded as his most important discovery — terrestrial stationary waves. By this discovery he proved that Earth could be used as a conductor and made to resonate at a certain electrical frequency. He also lit 200 lamps without wires from a distance of 40 km (25 miles) and created man-made lightning….”

Tesla died by being hit by a limousine in New York City. His notebooks were immediately stolen. I have no idea what came of them but it can be guessed that smart people would not have let Tesla’s insights got to waste. In any case, we do know from unclassified sources that the Raytheon Corporation has improved on “directed energy.” The main customer of Raytheon is the US Defense Department.

Professor Judy Wood claims that the Twin Towers of the New York World Trade Center were destroyed on September 11, 2001 by DEW – directed energy weapons. I originally dismissed her idea, as I thought that the reigning conspiracy had it right – that ordinary controlled demolition did the job. I also put faith in Danish Professor Niels Harrit’s theory that thermite was used. (See researchgate.net.)

I would not know thermite from a bar of soap, as we say in Australia. My ignorance needs to be taken into account here. But Judy Wood has been able to prove some aspects of the debris (or lack of debris) from the towers. You can find her TED talk on YouTube, or read my interpretation of Wood’s theory in my 2023 book Elias Davidsson. That book shows that since it cannot have been hijacked plane’s fuel fire that wrecked the Towers, it must have been something else.  Logic demands that 9/11” was an inside job.

As you know, the 9/11 miscreants skipped away with no blame. Why? Because such is the control of our federal government that no member thereof gets held to account. It’s easier to go on torturing Muslims at Gitmo (still happening after 22 years), in hopes that they might “tell us something.” As for those who were killed in the Twin Towers, they got a gag-ordered payment of two million dollars (on average) each, in a Victims’ Compensation fund from Congress – that is, from taxpayers.

The History of Persons Playing God

Although I won’t argue the details here, I think it can be shown that various natural events were not natural (unless you consider human power hierarchies and out-and-out sadism to be natural). To name three catastrophes that I have looked into:  the breach of the levies in New Orleans during Hurricane Katrina in 2005, the fires north of Melbourne near King Lake in 2009, and the earthquake in Haiti in 2010 which left 200,000 people dead.

None of those needed to have Tesla-level technology. Planted explosions would suffice for the New Orleans levies and the Haitian earthquake. The King Lake fire did seem to be done by a weapon, but not necessarily DEW. It is likely, however, that a DEW was the “guilty party” of the fire of the Grenfell Towers in London in 2017. As Sonia Poulton, a London journo reports, residents were told to return to their apartments even while the building was burning.

Whoever did the Lahaina fire had to have used a most unusual method, as can be seen in the fact that the metal of cars melted while grass and trees very close by were untouched. It can also be seen in the sparing of houses that had blue roofs, although we have yet to hear other explanations for that weird phenomenon.

Excuse me that I so far have not mentioned the jurisprudence of Article IV, section 4 of the Constitution. I will do that below.  To recap so far:

I claim that Hawaii was invaded by non-Hawaiians on August 8, 2023. For purposes of the Guarantee Clause, I “don’t care” what the purpose was — an invasion is an invasion.  Thanks to some post-1943 improvements on Nikola Tesla’s ideas, it is possible to create a fire at a distance (and to direct it precisely to a target). I agree with Judy Wood that a DEW explains the unusual features (not discussed here) of 9/11. I agree (with Sonia Poulton) that the Grenfell deaths were deliberately caused. Playing God has become a past-time for some people.  Famines and floods used to be “biblical.”

Until proven otherwise, the rebuttable presumption about the Lahaina fire is that a DEW was responsible.  I note that locals are already being asked to seek compensation through a lawsuit against the electric power company.  The lawyers for that class action state:

“The world has known that power lines have caused wildfires for more than 50 years; moreover, we know that the prevalence of wildfires caused by power lines has increased exponentially in the last 20 years, in great part due to climate change. Wildfires started by California power companies have burned more than 1 million acres and resulted in $10 billion in settlements…[etc]”

Note: But the fires in California may also have been aided by DEW!

Jurisprudence at “US Constitution, Annotated”

You may wish to know to what uses the famous Guarantee Clause has been put. It is easy to Google for “US Constitution annotated” You will be taken to a list of all US Supreme Court cases that bear on any section of the parchment. You’ll need to ask for Article IV, section 4 cases.  Also, if you choose the Google item written by Cornell University Law, you may find “Madison’s Notes” relevant to the section. This tell us what the men argued about as each and every line of the Constitution was written.

How and why did the Guarantee Clause cone about? Remember, the Declaration of Independence is dated 1776, and the Constitution was not written until 1787, and came into force on 1789.  Meanwhile, from 1781 to 1789, we had a ‘bridging’ government under the Articles of Confederation. The leaders at that time wanted to carefully to recruit all the eligible ex-colonies. Canada was invited to join but declined. (Note when the 6 Australian states federated in 1901, New Zealand was given the option to join.)

I am copying this history from the Cornell Law site. The superscript numbers take you to the specific cases:

“An early version of the Guarantee Clause was among the resolutions of the Virginia Plan introduced at the Constitutional Convention by Edmund Randolph and attributed to James Madison.3 The resolution went through several formulations during the debates at the [1787] Convention.4 During a key debate, Gouverneur Morris objected to the resolution because ‘[h]e should be very unwilling that such laws as exist in R[hode] Island ought to be guarantied.’ 5 Randolph explained that, rather than cementing the existing laws of the states, the resolution had two objects: ‘1. to secure Republican Government[;] 2. to suppress domestic commotions.’
“6 Along with concerns about rebellions, delegates expressed fears that a monarchy might arise in a particular state and ‘establish a tyranny over the whole [United States].’ 7 …
8 with Randolph then moving to add language that ‘no State shall be at liberty to form any other than a Republican [Government].’ 9 James Wilson then introduced, as a ‘better expression of the idea,’ … similar to the final form of the Guarantee Clause, which the Convention approved unanimously.10”

In reality, the only time the Clause has been used was during the Reconstruction period of the South in states that had seceded. Generally, the US Supreme Court has deemed the Guarantee Clause a “non-justiciable political question.” However in the civil rights era. it assisted the people of Jefferson County, Alabama, to get a long-overdue redistricting of voters for the House of Representatives. The case is Reynolds v Sims, decided in 1964.

What Can Be Done for Hawaii Now?

It is shocking that the ‘legacy media’ has not covered in depth the huge story of the Lahaina fire. The affected people are suffering every which way – from the shock of what happened, to the dim prospect of life returning to normal, to anger at non-responsive officials. Undoubtedly some prosecutions are warranted regarding, say, the blocking of streets to prevent escape, or the alleged cutting off of the water supply.

In order to set up my case for an invasion, I have identified the fire-makers as outsiders, not Hawaiian residents. That does not rule out action being taken against local officials who added to the tragedy after the fire or during the fire. The emphasis needs to be placed on providing a republican government for the state that was invaded.

The Constitution is at your beck and call. Most likely the good people of the nation will also be at your beck and call, as soon as they realize what actually took place on 8-8. Come on, don’t let unfamiliarity with this level of evil stop you from exercising your rational powers.

I know it’s easier to dismiss it than to concentrate on it. But the bad guys are counting on your taking that approach.  Let’s give them the surprise of their lifetime.  Let’s polish up that zinger of a weapon, the 1787 “piece of paper.” It can really direct some energy!

  1. Mary with regard to the 9/11 massacre, I am firm in the belief that both thermite and a DEW were used. The thermite was to weaken the pylons and girders to allow the DEW to do its work more efficiently.

    Car bodies and brake drums were melted, which could not be done by the heat of fires alone. Also the paint of cars was not completely stripped so it shows that the DEW technology doesn’t completely destroy ALL of a target. So these two technologies were used in synergy to complement each other.

    Dr Judy Wood believes the energy for the DEW was stolen from a cyclone (or hurricane for Americans benefit) that was travelling up the eastern coast, probably man-made that petered out after passing a certain point on the US coastline. That is the energy loss prevented it from crossing the land mass.

            Everybody reading Gumshoes knows about the fake swearing in of Biden and the separate roles of president and commander in chief. Further, the congress supplies the money and some factions of the army may go this way and others go that. Now the republicans have congress things may slowly change especially if they can improve on McCarthy. It still doesn’t excuse the Ukraina situation which is coming out of our tax. It doesn’t excuse the fact that all the banks are still cleaning up.           • Thank you, elspeth, for those links. You seem to be more interested in Biblical history than I, whose main interest is in the geo-political aspects to history.

            Don’t get me wrong, the Bible has proven to be a great historical record when searching through history, but the Bible has been made so convoluted with personal thoughts and writings, as to be a source of antagonism to the lay researcher.

            I am also aware – that much has been omitted from the Bible that could be a more enlightening guide, if made easily available to the avid researcher – Enoch and the Book of Q come to mind here.

            However, and in my opinion, the Bible has been deliberately put together to be an open conduit for personal interpretation.
