Long Live the Parchment, Long Live the People!  Who’s Next after Trump’s Impeachment?

It’s a good thing, a blessing, that President Donald Trump got impeached today. I blame us, the Republicans, for letting Trump get away with so much that he did in contravention of our principles – and the many things he could have done, or at least used the pulpit to preach about, but didn’t.

I’m also relieved to see some of the tension dissipate. It has been a rough season with each side claiming to be 100% right. (Of course, a House impeachment does not drive Trump from office. It remains for the Senate to “convict.”)

But there is much to be faulted in the one Article of Impeachment that passed the House on January 13, 2021, as HRes 24. I have bolded the parts that I disapprove of.

(This is from Congress.gov):  The article [of impeachment] states that

“prior to the joint session of Congress held on January 6, 2021, to count the votes of the electoral college, President Trump repeatedly issued false statements asserting that the presidential election results were fraudulent and should not be accepted by the American people or certified by state or federal officials;

“shortly before the joint session commenced, President Trump reiterated false claims to a crowd near the White House and willfully made statements to the crowd that encouraged and foreseeably resulted in lawless action at the Capitol;

“members of the crowd, incited by President Trump, unlawfully breached and vandalized the Capitol and engaged in other violent, destructive, and seditious acts, including the killing of a law enforcement officer;

“President Trump’s conduct on January 6, 2021, followed his prior efforts to subvert and obstruct the certification of the presidential election, which included a threatening phone call to the Secretary of State of Georgia on January 2, 2021;

“President Trump gravely endangered the security of the United States and its institutions of government, threatened the integrity of the democratic system, interfered with the peaceful transition of power, and imperiled a coequal branch of government; and

“by such conduct, President Trump warrants impeachment and trial, removal from office, and disqualification to hold U.S. office.”

My Objections

  1. I do not think one can say that a claim of fraudulent election is baseless until we have seen the facts. Most of the court cases were dismissed, which means the judge did not adjudicate.
  1. I do not think we can say that Trump incited the crowd without getting a lot more evidence.
  1. What’s this about “subverting” the certification?
  1. I would not label the call to Georgia’s Secretary of State “threatening.” I watched the state of Georgia’s senate hold a hearing on the matter of voter fraud and it looked very persuasive, but there again, no congressional people are willing to dealing with it. (The relevant committee chairman of the Georgia Senate actually requested Congress’s attention to the matter!)

Well, those four objections pretty much cancel out the honesty of today’s impeachment, so why do I deem it a blessing?   I think any attempt to curtail power is a blessing!

As I explained in a December 15, 2019 article at GumshoeNews.com, entitled “The Beauty of Impeachment,” it is great for people to be reminded of some of the remedies available.  Lex semper dabit remedium. Remember that catchy little phrase? “The law always provides a remedy.” Yay!

Naturally, we look forward with glee to having punishment meted out to any and all the miscreants of the fraudulent election (if such there was). And we await citizens throwing out the childish persons known as their “representatives.”

Off-topic, don’t forget that I am still trying to get Congress to impeach a judge who presided over the trial of a flat-out patsy in the Boson Marathon case. If the law makes a remedy available to us, why not use it?

There are remedies against the media’s behavior, too. I explained this in a series of articles at GumshoeNews.com. And a new area has opened up by the refusal of Twitter, Inc to “allow” a president to speak to the people. Look how the public took it as a given that a telecom owner could do that!

What Will Be Trump’s Fate?

Thank God we will know in one week if Biden will ascend the inaugural throne. This controversy has wasted so much of our time thus far. Five things may still happen:

A military action seems unlikely, as the Joint Chiefs of Staff (the Pentagon rulers) have now issued a statement saying they will not be involved.

A rescue by the white hats (if such there be) also seems extremely unlikely. I have never believed QAnon’s promises of “happiness just around the bend,” as there was never a justification for postponing the action. All Presidents have the means to do what Constitution obliges them to do — “to take Care that the Laws are faithfully executed.”

Last-minute court action is apparently not going to happen. There is such a thing as SCOTUS putting a matter into Fast-track, but they ruled this week that Sidney Powell’s cases won’t be fast-tracked. They will be heard in the Spring or the Fall. That’s OK. It will be wonderful to get the thing adjudicated when White House occupancy isn’t riding on it.

(Meanwhile, the defamation case launched by Dominion could lead to some surprise moves.  Sidney Powell’s skill in the courtroom is not to be sneezed at.)

At the moment, it is hard to figure out if the impeachment article will be acted on by the Senate.  Mitch McConnell said he won’t convene the Senate until January 19th, but he is no longer the Senate Majority leader.

Let’s inspect Article I, section 3, of the US Constitution:

“The Senate shall have the sole Power to try all Impeachments. When sitting for that Purpose, they shall be on Oath or Affirmation. When the President of the United States is tried the Chief Justice shall preside: And no Person shall be convicted without the Concurrence of two thirds of the Members present. Judgment in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States: but the Party convicted shall nevertheless be liable and subject to Indictment, Trial, Judgment and Punishment, according to Law.”

As we know, a year ago the whole contingent of Republican senators (except Mitt Romney who seemed to be having an uncharacteristic moment of piety) “spared” Trump from conviction. They made hay of Article I, section 3, by not holding a trial.  They called for a floor vote and that was that.

(Oh, you’ll want to know that Sen Lamar Alexander from Tennessee, made famous by Cathy O’Brien, said he was on the fence about convicting.)

I wonder if the requirement that all senators speak under penalty of perjury will affect the decision. And I wonder how the good ones (there must be a few?) will deal with the fact of the agent provocateurs in the “riot.”

Or the slightly touchy fact that “Special Ops” grabbed Pelosi’s laptop, which may have been the cause of a riot being arranged in the first place?

Imagine, people often don’t know FOR WHOM they work.

The other means of dethronement that has been gossiped about is the 25th Amendment. Yesterday Vice President Pence says he won’t initiate the 25th Amendment process of declaring Trump unfit.  Yet today, the House passed a resolution to encourage Pence to do that.

Trifecta

There is also talk of using the 14th Amendment.  I don’t think it’s worth discussing. It was intended for rebels of the Civil War – in other words, the Confederates of the secessionist states. It says that the wrongdoer will be banned from public office (but that a 2/3 vote by both houses of Congress could erase this disability.)

The president’s niece, Mary Trump, said in an interview today that she would like Congress to go for the “Trifecta.” That is, to use all three methods of removing her “dangerous” uncle from office.

Ms Trump does not seem to be aware at all that Uncle is obeying other powers. And what a cryin’ shame it be, that he is (by my lights, anyway) obeying other powers. Four years down the drain. God help us.

Do Not Worry Who Lives at 1600 Pennsylvania Av

Sure, I understand that if Trump won a landslide on November 3, 2020 – and I don’t for a minute rule that out – it would be nice to assure his passage into a second term.

(Heck, for that matter it would be nice to see the wrongly charged Julian Assange go free, or see Leonard Peltier, an old, sick prisoner, get justice after 45 years.)

But the occupancy 1600 Pennsylvania Av is not as crucial as you may think. When the Framers of the Constitution were trying to figure out what to do, they mentioned such things as a rotating president, or one who sits in the well of Congress.

I have sometimes referred to the level of the job of president as that of a scullery maid.  OK, that maybe incorrect, but it is the imagination of the people that makes the presidency seem so important, so impressive. His constitutional duties are few.

He is the Commander on Chief of the armed forces – the purpose of that set-up being to make sure the military does not get funny ideas about its own power. He is also the maker of deals with foreign leaders – that being the basis of an article of impeachment against Trump a year ago. (Withholding aid from Ukraine if they didn’t investigate a Biden or two for Burisma.)

The president also gets to appoint all officers of the US – but only with the consent of the Senate. The all-time biggie is that he – or she – is in charge of enforcing federal law.

It will be interesting to see what a President Biden would pick as his priorities in that realm. Immediately I hear you say he can’t act to punish any of the “protected persons.”

Well, if that is the case, then there you have it – it doesn’t matter one whit who sits in the White House.

    You’ve obviously assessed the evidence available and, on the balance of probability,come to this conclusion.

    You may be right or you may be wrong, but it’s great that you can come to a conclusion based on objectivity (a quality that’s in short supply here on Gumshoe amongst those with a dog in the race).

  7. There seems to be a body of evidence building to show that the ‘insurrection/riot” was PLANNED. The Capitol Police are accumulating the evidence, but won’t release it under FOI.

    If the riot was planned, then Trump could not have incited it on the day.

    • I was curious to look back and see what Trump was “]allegedly] impeached” for the first time – my Mandela filter thought it was for colluding with Russia. No – it was for exposing the corruption of Biden & Son involving the coup in the Ukraine, and its sequelae.

  12. Still on Covid, some of you might be aware that the UK has what are called ‘Covid Marshalls’.

    I’m guessing that they’re civilians recruited by the UK Government to ‘police’ mask enforcement / socialist-distancing and such.
